Ord 010-2003 2/4/2003ORDINANCE NO. ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING THE CODE OF ORDINANCES, CITY OF WICHITA FALLS, TEXAS, APPENDIX B, ZONING ORDINANCE, REGARDING LIMITED MULTIFAMILY RESIDENTIAL REGULATIONS; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the Planning and Zoning Commission has reviewed the proposed amendments to the Zoning Ordinance and has recommended their approval; and WHEREAS, the City Council of the City has determined that the changes recommended herein are in the public interest. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The Code Of Ordinances, City Of Wichita Falls, Texas, Appendix B, Zoning Ordinance, shall be amended by adding Section 5915, Limited Multifamily Residential Regulations. The text to be added is shown underlined: 5915 Limited Multifamily Residential Regulations Purpose The purpose of the limited multifamily residential regulations is to provide for consideration of multiple duplexes, one or more triplex or fourplex structures within a single - family district. Limited multifamily structures shall be compatible in appearance with new single - family residences. 1. Number of stories: There shall be allowed with an approved site plan that considers adjacent or neighboring single - family dwellings, 2 -story units where there is a single family. There shall not be a separate dwelling unit above another dwelling unit. 2. Front Setback: 25 ft. minimum. 3. Side Setback, interior: 5 ft., minimum except where the additional setback provisions of Section 4670 apply. 4. Side setback, exterior: 15 ft. minimum. 5. Rear Setback: 5ft., except where the additional setback provisions of Section 4670 apply. 6. Building Coverage: 55% maximum. V, 7. Open Space: 20% of lot area shall be open space. 8. Parking: 2 spaces on -site per dwelling unit minimum. Parking areas shall be designed where vehicles do not back out into the street. 9. Fencing and Screening: See Section 4600. 10. Landscaping: See Section 6800. SECTION 2. The Code Of Ordinances, City Of Wichita Falls, Texas, Appendix B, Zoning Ordinance shall be amended as follows with underlined text to be added: a. Section 3070, Limited Multifamily Residential Uses, Subject to the provisions of Section 5915 shall be added to the list of Conditional Uses, under Residential Uses. b. Section 3130, Limited Multifamily Residential Uses, Subject to the provisions of Section 5915 shall be added to the list of Conditional Uses, under Residential Uses. C. Section 3080, Development Regulations shall be amended by adding the following underlined text: "Each site in the SF -1 District shall be subject to the following site regulations except zero lot line single family dwellings and limited multifamily residential developments:" d. Section 3140, Development Regulations shall be amended by adding the following underlined text: "Each site in the SF -2 District shall be subject to the following site regulations except for zero lot line single family residential use and limited multifamily residential developments:" SECTION 3. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law. PASSED AND APPROVED this the 4th day of February, 2003.
