Ord 079-2003 9/2/2003ORDINANCE NO. r1�1-O�J ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING PART II OF THE CODE OF ORDINANCES AT CHAPTER 2, ARTICLE VI, DEVELOPMENT FEES; PROVIDING A REPEALER CLAUSE; PROVIDING FOR INCLUSION IN THE CODE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the City provides plan review and inspection services for building construction activities to promote the safety of its citizens; and WHEREAS, the City Council has determined the necessity to maintain a fee schedule to support the costs of such operations. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Part II of the Code of Ordinances, Chapter 2, Article VI, Development Fees, is amended to read as follows: "Chapter 2 ADMINISTRATION* ARTICLE VI. DEVELOPMENT FEES Sec. 2 -906. Building Permits and Inspections. A minimum fee of $20.00 shall be charged for issuing any class of permit required by the building code and as required in this section. In addition to the minimum fee there shall be charged the following inspection fees: (1) New building construction or addition: a. Single- family or duplex residence, per square foot of building or addition ... $0.15 b. Single- family or duplex use storage, outbuilding, carport or patio, per square foot of building or addition ... 0.05 C. Commercial use, which includes all other occupancies not listed in subsections (1)a and (1)b of this section, per total square feet of building or addition ... 0.27 d. Commercial storage building, per total square feet of building or addition ... 0.09 e. Commercial plan review, per square foot of covered area ... 0.08 (2) Finish out of existing shell buildings or areas within shell buildings, per total square feet of area ... 0.065 (3) Repair, alteration or remodel of existing buildings, per total dollar valuation of work ... 0.005 (4) Roofing or siding, per square foot of area covered or repaired ... 0.005 (5) Foundation only, per square foot of area of foundation ... 0.003 (6) Signs, each: a. Aviation, traffic and transportation department fees for moves two hours or less in duration ... 100.00 b. Aviation, traffic and transportation department fees for moves exceeding two hours in duration will be the base rate of $100.00, plus a charge of $65.00 per hour or any part of an hour, per vehicle used for the time exceeding two hours. C. Police department fees for moves two hours or less in duration ... 75.00 d. Police department fees for moves exceeding two hours in duration will be the base rate of $75.00, plus a charge of $50.00 per hour or any part of an hour, per vehicle used for the time exceeding two hours. (9) Swimming pool ... 20.00 (10) Mobile or manufactured home installation outside of a mobile home park ... 20.00 (11) Flammable or combustible liquid storage tank or service station pump: a. Each new tank or replacement, which includes test verification ... 15.00 b. Each new pump or replacement, which includes test verification ... 5.00 C. Repair and /or tests of existing tanks, pumps, or lines ... 5.00 (12) Fire suppression system: a. Each new sprinkler system ... 65.00 b. Each new standpipe system ... 26.00 C. Each new vent -hood extinguishing system ... 15.00 d. Repair or alteration of an existing fire suppression system . . . 10.00 (13) Fireplace ... 5.00 (14) Miscellaneous: a. Demolition cleanup deposit, refundable to the permittee following final inspection approval, per square foot of all structures at each location ... 0.05 b. Reinspection permit ... 5.00 C. General inspection or occupancy change ... 5.00 d. Equipment or structures not listed in subsection (14)a through (14)c of this section ... 10.00 e. A permit fee may be refunded to the payee upon approval of the building and code administrator. f. Building, electrical, plumbing or mechanical permits issued to premises located outside of the city limits shall include an additional inspection service charge of $ 20.00. Sec. 2 -907. Electrical permits. A minimum fee of $20.00 shall be charged for issuing any class of electrical permit required by the electrical code and as required in this section. In addition to the minimum fee there shall be charged the following inspection fees: (1) New building or addition or complete rewire of existing buildings: a. Single- family, multifamily or duplex use not exceeding three stories, which includes an attached or detached residential garage, storage or outbuilding, per square foot of building or addition ... $0.015 b. Commercial use, which includes all other occupancies not listed in subsection (1)a of this section, per square foot of building or addition ... 0.026 C. Commercial storage, warehouse or parking garage, which does not apply to accessory office areas, per square foot of building or addition ... 0.0075 (2) Alteration, repair, addition to or replacement of electrical installations or existing single - family, duplex, or multifamily residences or premises, for each: a. Mechanical permits. A minimum fee of $20.00 shall be charged for issuing any class of permit required by the city mechanical code. In addition to the minimum fee there shall be charged the following inspection fees: (1) For the installation or complete changeout of an environmental air conditioning system or equipment in each building: a. Single- family or duplex use: Total Btu's of all equipment and units divided by 12,000 times $ 1.50 Total Btu's /12,000 X $ 1.50 b. Commercial use, for all other occupancies not listed in subsection (1)a of this section: Total Btu's of all equipment and units divided by 12,000 times $ 2.25 Total Btu's /12,000 X $ 2.25 (2) Addition to, repair or alteration of an existing HVAC system or equipment, which includes air - handling units, per total dollar valuation of work ... $0.0075 (3) Exhaust systems, each separate system ... 5.00 (4) Boilers: Total Btu's of all equipment divided by 12,000 times $ 1.50 Total Btu's /12,000 X $ 1.50 (5) For the installation or complete changeout of a refrigeration system in each building: Total Btu's of all equipment divided by 12,000 times $ 1.50 Total Btu's /12,000 X $ 1.50 (6) Addition to, repair or alteration of an existing refrigeration system, per total dollar valuation of work ... 0.0075 (7) Reinspection ... 5.00 (8) Other equipment or appliances not listed, each ... 5.00 (9) Temporary operation or general inspection of existing equipment ... 5.00 Sec. 2 -912. Contractor work permit. (a) In lieu of the permits and fees listed in sections 2 -907 through 2 -909, the building code administrator shall be authorized to issue and charge for a contractor work permit. Such contractor work permit, when so issued, shall authorize the repair, replacement or installation of appliances or fixtures regulated by the plumbing, electrical or mechanical code, and as specified by the building code administrator. Contractor work permits shall only be issued to licensed master plumbers, licensed master or industrial electricians or licensed air conditioning contractors as required by the applicable city codes. (b) A fee of $250.00 shall be charged for each contractor work permit, which shall authorize and include ten separate permits for work at individual work sites or locations. (c) Any work authorized by such contractor work permit shall not be commenced until an individual permit has been completed in full by the contractor for each location of work and is posted or otherwise available at the job site of such proposed work. A contractor who is found doing work without this permit completely filled out and on the job site shall be treated as working without a permit and subject to a penalty of 100 percent of the usual permit fee, in addition to the required permit fees. (d) If, at any time, any license, bond or insurance, as required by the city or state, is revoked or expires, all permits issued pursuant to a contractor work permit shall become null and void until such time as the license, bond or insurance has been acquired and /or reinstated. (e) A contractor work permit will also be issued for patching and /or repair of residential and commercial roofs. This permit can be used as follows: (1) Residential. Not to exceed over 200 square feet and in no case exceed over 25 percent of the whole roof. If a flat and a pitched roof are on the same residence, each shall be considered separately. (2) Commercial. Not to exceed over 500 square feet and in no case exceed over 25 percent of the whole roof. This work permit is to be used solely for patch or repair work only. If any decking is to be replaced, regardless of the amount, a regular permit must be issued before work is commenced. A permit is not required when tear -off is not required." SECTION 2. It is the intention of the City Council of the City of Wichita Falls, Texas, that the provisions of this ordinance shall become a part of the Code of Ordinances of the City of Wichita Falls, Texas, and that sections of this ordinance may be renumbered or relettered to accomplish such intention. SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. Should any word, phrase, paragraph, section or portion of this ordinance or the Code of Ordinances, as amended hereby, be held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 5. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
