ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AMENDING PART II OF THE CODE OF ORDINANCES,
CHAPTER 22, BUILDINGS AND BUILDING REGULATIONS, AT
ARTICLE V, MECHANICAL CODE; BY MAKING CERTAIN ADDITIONS,
DELETIONS AND AMENDMENTS THERETO; PROVIDING A
REPEALER CLAUSE; PROVIDING FOR INCLUSION IN THE CODE;
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the Construction Board of Adjustment and Appeals has determined
that amendments to Section 22, Buildings and Building Regulations of the Wichita Falls
Code of Ordinances, are necessary to advance public purposes relating to safety,
quality of life, appearance, and function of the City; and
WHEREAS, the Construction Board of Adjustment and Appeals recommends the
adoption of the 2000 International Mechanical Code, as amended herein; and
WHEREAS, the City Council concurs with such adoption.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 22.511 of the Code of Ordinances is hereby amended to
read as follows:
"Sec. 22.511. Adopted.
The following code, published by the International Code Council, is adopted by
reference as though it were copied fully in this section: 2000 International Mechanical
Code, including Chapters 1 -15."
SECTION 2. The first sentence of Section 22 -512 of the Code of Ordinances is
hereby amended to read as follows:
"Sec. 22 -512. Adopted.
The following changes, deletions and amendments are made in the International
Mechanical Code adopted in section 22- 511:"
SECTION 3. The existing language of Section 22 -512 of the Code of Ordinances
is hereby amended to include the following:
COMMENTARY.- The majority of section 103, Department of Mechanical Inspection, is
being deleted and the information contained therein is covered in section 104 of the
International Building Code, which has been previously adopted.
"SECTION 103. BUILDING AND CODE ADMINISTRATION DIVISION
103.1 General. There is hereby established a division to be called building and
code administration, and the person in charge shall be known as the building and code
administrator. Any reference in this code or other code to building official or code official
shall be held to mean the building and code administrator.
COMMENTARY. The following Sections 104 and 105 are being deleted and replaced
by a reference to the same information that is contained in Section 104 of the
International Building Code, which has been adopted.
SECTION 104. DUTIES AND POWERS OF THE CODE OFFICIAL
104.1 General. This section shall comply with Chapter 22, Buildings and Building
Regulations, Section 22 -27, Changes, deletions and amendments, Section 104, Duties
and Powers of the Building Official, in the Code of Ordinances, City of Wichita Falls,
Texas.
Section 105 is deleted.
COMMENTARY.- The following addition in text coincides with State regulations and is
added for clarification.
106.1. When required. An owner, authorized agent or contractor who desires to
erect, install, enlarge, alter, repair, remove, convert or replace a mechanical system, the
installation of which is regulated by this code, or to cause such work to be done, must
have a Texas Air Conditioning and Refrigeration Contractors License and an E.P.A.
Recovery Certificate to do any work other than duct work, and shall first make
application to the code official and obtain the required permit for the work.
Exception: Where equipment and appliance replacements or repairs must be
performed in an emergency situation, the permit application shall be
submitted within the next working business day to the Building and Code
Administration Division.
COMMENTARY.- This section will be changed to reference the existing fee schedule
previously adopted into the code of ordinances.
106.5.2 Fee schedule. The fees for mechanical work shall be as indicated in the
schedule located in City of Wichita Falls code of ordinances, Chapter 2 Administration,
Article VI, Development Fees at Section 2 -908, Plumbing permits, or as amended
hereafter.
106.5.3 Fee refunds. The code official is authorized to establish a refund policy.
SECTION 109. MEANS OF APPEAL
109.1 General. This section shall comply with Chapter 22, Section 22 -27,
Changes deletions and amendments, Section 112, Board of Appeals, in the Code of
Ordinances, City of Wichita Falls, Texas.
COMMENTARY.- Exception #2 is added to clarify required ventilation requirements.
403.3 Ventilation rate. Ventilation systems shall be designed to have the capacity
to supply the minimum outdoor airflow rate determined in accordance with Table 403.3
based on occupancy of the space and the occupant load or other parameter as stated
therein. The occupant load utilized for design of the ventilation system shall not be less
than the number determined from the estimated maximum occupant load rate indicated
on Table 403.3. Ventilation rates for occupancies not represented in Table 403.3 shall
be determined by an approved engineering analysis. The ventilation system shall be
designed to supply the required rate of ventilation air continuously during the period the
building is occupied, except as otherwise stated in other provisions of the code.
#1 Exception: The occupant load is not required to be determined, based on
the estimated maximum occupant load rate indicated in Table 403.3, where approved
statistical data document the accuracy of the alternate anticipated occupant density.
#2 Exception: Scheduled outdoor air ventilation is not required for single or
multifamily dwelling except when entrance is through a common enclosed corridor.
Exhaust air is required as scheduled."
SECTION 4. Any other Code referenced within the 2000 International Mechanical
Code, which has not been adopted by the City of Wichita Falls, shall not be considered
as a local ordinance.
SECTION 5. Commentary sections have been included for explanation and
clarification and are not to be considered in the text of the ordinance.
SECTION 6. It is the intention of the City Council of the City of Wichita Falls,
Texas, that the provisions of this ordinance shall become a part of the Code of
Ordinances of the City of Wichita Falls, Texas, and that sections of this ordinance may
be renumbered or relettered to accomplish such intention.
SECTION 7. All ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 8. Should any word, phrase, paragraph, section or portion of this
ordinance or the Code of Ordinances, as amended hereby, be held to be void or
unconstitutional, the same shall not affect the validity of the remaining portions of said
ordinance or the Code of Ordinances, as amended hereby, which shall remain in full
force and effect.
SECTION 9. It is officially found and determined that the meeting at which this
ordinance was passed was open to the public and required by law."
