Ord 119-2003 12/2/2003ORDINANCE NO.� O�- 6-A0b3 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING THE CODE OF ORDINANCES AT ARTICLE I, CHAPTER 94, TO REGULATE THE USE OF MOTOR ASSISTED SCOOTERS ON ANY STREET, HIGHWAY OR ALLEY IN THE CORPORATE LIMITS OF THE CITY OF WICHITA FALLS; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, motor assisted scooters, as defined in this ordinance, constitute a danger to the operators when driven upon city streets; and, WHEREAS, motor assisted scooters operated on city streets also constitute a traffic safety hazard to other drivers and pedestrians; and WHEREAS, the City Council has determined that regulation of motor assisted scooters is necessary for the health, safety and welfare of the citizens of Wichita Falls. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The City Council finds and determines that the use of motor assisted scooters presents a traffic safety hazard to other drivers and pedestrians, and restrictions on the use of motor assisted scooters in the City of Wichita Falls is necessary in the interest of safety. SECTION 2. Article I of the Code of Ordinances is hereby amended by the addition of Section 94 -15, Motor Assisted Scooters, which shall read as follows: "Sec. 94 -15. Motor Assisted Scooters (a) A "motor assisted scooter" means a self - propelled device with: 1. at least two wheels in contact with the ground during operation; 2. a braking system capable of stopping the device under typical operating conditions; 3. a gas or electric motor not exceeding 40 cubic centimeters; 4. a deck designed to allow a person to stand or sit while operating the device; and 5. the ability to be propelled by human power alone. I L (b) Requirement for Operation. 1. A motor assisted scooter may be operated only on a street, highway or alley for which the posted speed limit is 30 miles per hour or less. The vehicle may cross a road or street at an intersection where the road or street has a posted speed limit of more than 30 miles per hour only if the operator walks the vehicle across the street while observing all applicable pedestrian laws. 2. A person shall not operate a motor assisted scooter on a street or highway during the hours the street or highway is a designated school zone. 3. A motor assisted scooter may only be operated on a street, highway or alley from sunrise till sunset, as defined by State law. 4. A person operating or riding on a motor assisted scooter on a street, highway or alley must wear protective headgear at all times. 5. A person operating a motor assisted scooter on a street, highway or alley must do so following all State provisions applicable to the operation of a bicycle. (c) Adult Supervision. 1. A motor assisted scooter may not be operated on a street, highway or alley by a person younger than ten years of age. 2. A person shall not recklessly allow a child in their care, who is under the age of ten years old, to operate a motor assisted scooter on a street, highway or alley. (d) Any violation of this section is a class C misdemeanor punishable by a fine as provided in section 1 -14." SECTION 3.
