Ord 1805 6/23/1958AN ORDINANCE No. 1805 AMENDING ORDINANCE NOo 1674, PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, ON DECEMBER 21, 1953, PRESCRIBING RATES AND CHARGES FOR LOCAL EXCHANGE TELEPHONE SERVICE FURNISHED BY SOUTHWESTERN BELL TELEPHONE COM- PANY IN THE CITY OF WICHITA FALLS, TEXAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS Section 1: That Ordinance No. 1674 passed and approved December 21, 1953, prescribing rates and charges for local exchange telephone service furnished by Southwestern Bell Telephone Company in the City of Wichita Falls, Texas, be and is hereby amended by deleting from Section 1 of said ordinance the following; "Rates and charges for miscellaneous services and equipment shall. remain as heretofore established except as superseded by those rates and charges contained in the Schedule of Miscellaneous Rates and Charges attached hereto and made a part hereof. " and by substituting therefor the following: "Rates and charges for miscellaneous services and equipment shall remain as heretofore established except as superseded by those rates and charges contained in the Schedule of Miscellaneous Rates and Charges attached hereto and made a part hereof; provided, however, that Southwestern Bell Telephone Company shall have the right to file from time to time with the City Secretary different rates and charges for such miscellaneous services and equip- ment, such different rates and charges to become effective 30 days after filing unless otherwise ordered by the City Council. " Section 2e That said Ordinance Noe 1674 be and is hereby further amended by deleting from Section 1 of said ordinance the following: "Four Party Residence Service 3, 25 Local Messages Under Guarantee - each . 05 Local, Messages Over Guarantee - each .0411 and by substituting therefor the following: "Four Party Residence Service 3, 25 (d) Local. Messages Under Guarantee - each a 05 (e) Local Messages Over Guarantee - each .04 (e)" M - 2 - Section 3. That said Ordinance No. 1674 be and is hereby further amended by adding the following notes to Section 1 of said ordinance; "(d) Four -party residence telephone service is authorized only until such time as telephone facilities are avail- able to furnish two -party residence telephone service to the then existing four -party residence telephone customers; at such time, four -party residence tele- phone service shall be discontinued. "(e) That authority to increase the charge for local messages from coin box telephones to ten cents (10�) per message is hereby granted, to become effective when the Tele- phone Company completes equipment modifications necessary to the due rendition of telephone service from such coin box telephones on this basis. With the making effective of a charge of ten cents for local messages from such coin box telephones, the rate to the sub- scriber to semi - public coin box telephone service shall be eight and three - quarters cents (8 -3/4y) per message for calls over the daily guarantee and ten cents (10�) per message for calls under the daily guarantee. " Section 4. All ordinances heretofore passed by the City of Wichita Falls establishing rates and charges for telephone service, except said Ordinance No. 1674 as hereby amended, be and are hereby repealed. Section 5e Nothing in this ordinance contained shall be construed now or hereafter as limiting or modifying, in any manner, the right and power of the city under the law to regulate the rates and charges of South- western Bell Telephone Company. % Passed and approved this the day of 1958.
