Ord 1840 7/27/1959r ORDINANCE N0. / AN ORDINANCE REPEALING ORDINANCE NO. 1786 WHICH 14AS AN ORDINANCE TO PROVIDE FOR PERr.ITS FOR IviILK PRODUCERS AIAM OUT OF CITY MILK t.i1D ICE CREAM PRODUCERS SELLING PRODUCTS LTITHIN THE CITY OF WICHITA F,J LS AND AMENDING ORDINANCE NO. 1667 WHICH IS AN ORDINANCE TO REGULt�TE THE PRODUCERS AND SELLERS OF MILK AND MILK PRODUCTS; TO PROVIDE FOR PER1,1ITS FOR MILK PRODUCERS, MILK HAULERS FOR HIRE. BULK MILK HAULERS; OUT OF CITY MILK AND ICE CREAM PROCESSORS SELLING PRODUCTS WITHIN THE CITY OF WICHITA FALLS, TEXAS; OUT OF CITY ICE CREAM AND/OR ICE CREAM MIX PRO- CESSORS SELLING PRODUCTS WITHIN THE CITY OF ?TICHITA FALLS, TEX..S, OR ITS POLICE JURISDICTION, FEES CHARGED MILK PROCESSORS; AND TO PROVIDE FOR A YEARLY PERMIT FOR MILK PRODUCERS AS WELL AS FOR MILK HAULERS FOR HIRE. BE IT ORDAIIIED BY THE BOARD OF ALDERIVUEN OF THE CITY OF JJICHITA FALLS, TEXAS: SECTION I. That Ordinance no. 1786 is hereby repealed. SECTION II. That Ordinance No. 1667 of the City of Wichita Falls is hereby amended to include the following: 119(a) All milk producers, milk haulers for hire, and bulk milk haulers shall be required to secure a permit from the Director of Public Health on January 1 of each year at the rate of Ten Dollars ($10.00) per annum. 9(b) All milk processing plants which are regularly in- inspected by a milk sanitarian of the City- County Health Unit shall be required to secure a permit January 1 of each year from the Director of Public Health for a fee of $100.00. These plants shall not be limited to the municipality of Wichita Falls, Texas. 9(c) All milk processing plants which are not regularly inspected by a milk sanitarian of the City- County Health Unit shall be required to secure a permit on January 1 of each year from the Director of Public Health for a fee of $200.00. 9(d) All out of the City ice cream and /or ice cream mix processors shall be required to secure a permit on January 1 of each year from the Director of Public Health for a fee of $25.00. Milk haulers as used herein shall mean any person or persons picking up milk from producers holding Grade ti permit issued by the Wichita Falls Health Unit and delivering to local milk pro- cessing plants." SECTION III. It being immediately necessary to the public peace, health and safety, an emergency is hereby declared to exist and by reason thereof this ordinance shall take effect and be in full force from and after the date of its passage., PASSED AND APPROVED this 27th day of July, 1959.
