Ord 1837 7/13/1959ORDINANCE NO. 1839 AN CRDINANCE TO CONTROL TUBERCULOSIS; AND TO CONTROL BRUCELLOSIS UNDER PLAN AS RECOMMENDED BY THE BUREAU OF ANIMAL HUSBANDRY, UNITED STATES DEPARTMENT OF AGRICULTURE, AND OTHER DISEASES; AND PROVIDINJ FOR TESTS OF MILK HERDS, THE ISSUANCE AND FILING OF CERTIFICATES TO ACCREDITED ANIMALS AM HERDS AND THE PERMANENT EXCLUSION OF CERTAIN COWS FROM THE HERDS, THE DISPOSITION OF REACTORS; AID PROVIDING FCR A PENALTY FCR THE VIOLATION THEREOF. BE IT CRDA I NED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS9 TEXAS: SECTION 1: At least once each 12 months a tuberculin test of all herds and additions thereto shall be made by a licen- sed veterinarian recognized by the Texas Animal Health Commission. Said tests shall be made and any reactors disposed of in accord- ance with the requirements of the Bureau of Animal Husbandry, U. S. Department of Agriculture, for accredited herds: A certifi- cate identifying each animal by ear tag or ear tattoo, signed by the veterinarian or attested to by the Health Officer, and filed as directed by the Health Officer, shall be evidence of the above test. 'SECTION 2: From and after the effective date of this ord inance,a l l milk and mi ik products for pasteurization offered for sale in Wichita Falls, Texas, shall be,from herds certi- fied by the Texas Animal Health Commission, as following Plan A as approved by the State Department of Agriculture and the U. S. Department of Agriculture for the eradication of brucellosis. Evidence of this certificate shall be filed as directed by the Health Officer,, All additions to the herd shall be brucellosis free. Tests and retests shall be made, and any reactor disposed of in accordance with the requirements of the U. S. Department of Agriculture. A certificate identifying each animal, signed by the veterinarian and the director of the laboratory making the test, and filed as directed by the Health Officer, shall be evidence of the above test. SECTION 3: Cows which show a complete induration of one quarter or extensive induration in one or more quarters of the udder upon physical examination, whether secreting abnormal milk or not, shall be permanently excluded from the milking herd; pro- vided, that this shall not apply in'the case of a quarter that is completely dry. Cows giving bloody, stringy or otherwise ab- normal milk, but without entire or extcnsive induration of the udder, shall be excluded from the herd until re- examination shows that the milk has become normal. SECTION 4: For other diseases, such tests and exami- nations as the Health Officer may require after consultation with the Texas Animal Health Commission shall be made at intervals and by methods prescribed by it, and any diseased animals or reactors shall be disposed of as it may require. SECTION 5: Any person who shall violate any provision of this ordinance shall be fined not less than $ 10.00 nor more than $100.00 at the discretion of the court. Each and every violation of any provision of this ordinance shall constitute a separate violation. SECTION 6: All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed, and the in- validity or unconstitutionality of any part of this ordinance shall not void any other valid or constitutional portion thereof.
