HEIGHTS ADDITION TO THE CITY OF WICHITA FALLS, WICHITA CO'UM t TEXAS, FROM TYLER TO POLK STREET, RESERVING EASEMENTS THEREUNDER; REQUIRING SEWER LINES THEREUNDER TO BE ENCASED IN CCNrRETE AND ADFOUATE XIANHOLES- PROVIDED IN CASE A BUILDING IS ERECTED ON THE PROPERTY, AND INDEMNIFYING THE CITY AGAINST ANY CLAIMS. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1: That the following described property situated in the City of Wichita Falls, Wichita County, Texas, BEING the alley in Block Twelve (12) of Floral Heights Addition to the City of Wichita Falls, Texas, between Tyler and Polk Streets, be and the same is hereby closed and abandoned to public use as an alley, but reserving thereunder all utility easements as they now exist. SECTION 2: That the utility easements thereunder, particularly the sewer line, is hereby re- served as an easement, with the right of ingress and egress, con- struction, reconstruction and repair of the same, and in the event a building is built over the same, the builder will encase the sewer line in concrete and provide adequate manholes on either side of the building so constructed not more than one hundred feet (1001) apart. That such work shall be done under the supervision and direction of the City Engineer of the City of Wichita Falls, whose judgment thereon shall be final. SECTION 3: Any expenses in complying with this ordinance shall be borne solely by the property owner or builder and the City of Wichita Falls shall be held harmless for such expenses. SECTION 4: In consideration of the passage of this ordinance, the Floral Heights Methodist Church agrees to hold harmless the City of Wichita Falls from any claim or claims for damages, or of any other kind or character of claims, including attorneyts fees and expenses of investigation, in the event that any claim or claims are ever made by reason of the abandonment of these premises.
