Ord 2301 2/13/1967 ORDINANCE NO. c.,g1/ AN ORDINANCE PROHIBITING THE OPERATION OF TATTOO ESTABLISHMENTS AND THE PRACTICE OF TATTOOING WITHIN THE CITY OF WICHITA FALLS; DEFINING THE TERMS USED HEREIN; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; AND PROVIDING FOR AN EMERGENCY CLAUSE AND A SAVING CLAUSE. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS : SECTION 1. Purpose - Due to the fact that the tattooing of persons involves the injecting of foreign substances into the human body, and due to the fact that such injections are often harmful to the health of the persons tattooed and due to the fact the instruments used in tattooing and the environmental conditions of the tattoo establishments are potential health hazards, it is the desire of the Board of Aldermen to protect citizens of this City by passing an ordinance prohibiting persons from engaging in the practice of tattooing. SECTION 2 . Definitions A. Tattoo - The word "tattoo" shall mean to mark or color the skin of a human by pricking in coloring matter so as to form indelible marks or figures, or by the production of scars. B. Tattoo Establishment - The words "tattoo establishment" shall mean any room or space where tattooing is practiced or where the business of tattooing is conducted, or any part thereof. SECTION 3. Prohibiting Tattooing and Tattoo Establishments It shall be unlawful for any person in the City to operate a tattoo establishment or engage in the practice or business of tattooing human beings. SECTION 4. Penalty Clause - Any person who shall violate any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and on conviction thereof shall be punished by a fine in any sum not to exceed Two Hundred Dollars ($200.00) , and each day' s operation shall constitute a separate offense. SECTION 5. Saving Clause - If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance, and the Board of Aldermen hereby declares that it would have passed this ordinance, and each section, subsection, sentence, clause or phrase thereof irrespective of the fact that any one or more of the other sec- tions, subsections, sentences, clauses or phrases be declared unconstitutional and invalid. SECTION 6. Emergency Clause - The fact that the City of Wichita Falls does not have an ordinance prohibiting the tattoo- ing of human beings, and the fact that such acts are a health - 2 - hazard, creates an emergency, and necessitates that this ordin- ance be declared an emergency measure, and that this ordinance shall become effective immediately after its passage.
