Ord 2364 10/23/1967 ORDINANCE NO. (O AN ORDINANCE AMENDING SECTIONS 5-11, 5-45, 5-46 AND 5-57 OF THE CODE OF ORDINANCES OF THE CITY OF WICHITA FALLS, AND ADDING SECTIONS 5-59 AND 5-60 ; PREVENTING DOGS FROM RUNNING AT LARGE; PREVENTING CERTAIN DOGS UPON THE PREMISES OF ONE OTHER THAN THE OWNER; PREVENTING PERSONS FROM INTERFERING WITH THE ANIMAL WARDENS IN CARRYING OUT THEIR DUTIES ; QUARANTINING OF RABID DOGS, ANIMALS AND ANIMALS WHICH HAVE BITTEN PERSONS; COST OF IMPOUNDING BITING ANIMALS; REQUIRING DOGS TO WEAR COLLARS OR HARNESS WITH ATTACHED CURRENT RABIES TAG AND CITY PERMIT TAGS; DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Section 5-11 of the Code of Ordinances of the City of Wichita Falls is hereby amended so that such Sec- tion shall read as follows : "Section 5-11. Quarantining of rabid dogs or animals and animals which have bitten persons . Every animal of the canine or feline species that has rabies or symptoms thereof, or any animal that bites, scratches , or otherwise attacks any person or persons within the city limits, shall be, upon com- plaint of the injured person, either quarantined and held for a period of ten (10) days in any veterinary hospital approved by the Director of Public Health, the City Animal Pound or if the person or persons attacked gives written permission, the owner of the said animal may keep the animal confined in a fenced area by tying with a chain of good quality for a like period of time. If the said animal is confined by the owner, the animal warden or his deputies shall have the right at any reasonable time to inspect said animal to determine if the animal is securely confined and if the animal is showing any symptoms of rabies the animal will be immediately im- pounded. If the owner or keeper of any such animal shall violate this Section by not confining such animal in a fenced area and by tying with a chain of good quality for said re- quired period of time, such owner or keeper shall be deemed guilty of a misdemeanor. " SECTION 2 . Section 5-45 of the Code of Ordinances of the City of Wichita Falls is hereby amended so that such Sec- tion shall read as follows : "Section 5-45. The running at large of a dog or dogs within the City is hereby declared a nuisance, and positively prohibited, and it is hereby made unlawful and deemed a mis- demeanor for the owner or keeper of any dog or dogs to allow the same to run at large within the City limits. " SECTION 3. Section 5-46 of the Code of Ordinances of the City of Wichita Falls is hereby amended so that such Sec- tion shall read as follows : - 2 - "Section 5-46. Confinement of dogs . No dog or dogs of fierce, dangerous, or vicious propensities, and no female dog in heat, whether licensed or not shall be allowed upon the pre- mises of one other than the owner regardless of whether said dog is under the control of the owner, either by leash, cord, chain, or otherwise. Any such dog found upon the premises of one other than the owner shall be taken up and impounded and shall not be released except after payment of the fees provided in Section 5-66; provided, however, that if any dangerous, fierce, or vicious dog so found cannot safely be taken up and impounded, such dog may be slain by any police officer. " SECTION 4. Section 5-57 of the Code of Ordinances of the City of Wichita Falls is hereby amended so that such Sec- tion shall read as follows : "Section 5-57. Interfering with authorities. No per- son shall interfere with or attempt to prevent the animal warden, any of his deputies, or any police officer from catch- ing or impounding any dog running at large. " SECTION 5. The Code of Ordinances of the City of Wichita Falls is amended by adding a Section to be numbered 5-59, to read as follows : "Section 5-59. Cost of impounding biting animals . When a person attacked requires impoundment of the animal doing the biting, such impoundment shall be at the expense of the owner of the animal; except that where at the time of the said biting, the said animal was wearing a collar or harness with valid li- cense and rabies tags attached thereto and was lawfully re- strained or on the owner ' s premises as required by this ordi- nance, then the expense of confinement shall be against the person so attacked, unless such person is on the premises with the expressed or implied consent of the owner, such as in the case of delivery men, postmen, or utility meter readers, etc. , in which event the cost of confinement shall be at the owner' s expense " SECTION 6. The Code of Ordinances of the City of Wichita Falls is amended by adding a Section to be numbered 5-60, to read as follows : "Section 5-60. Requiring collars or harnesses. It shall be unlawful for any person to keep or maintain a dog more than four months of age on any premises within the City of Wichita Falls unless such dog wears a collar or harness securely attached to its body to which shall be securely attached a current rabies tag issued for said dog by a licensed veterinarian, and also securely attached to said collar or harness a City permit tag. " SECTION 7 . The fact that many people live within the City of Wichita Falls and there is an urgent need for protection against dogs and animals, this ordinance is declared an emergency measure on the ground of urgent public need for the preservation of the peace, health, and safety of the citizens of the City and said ordinance shall take effect immediately upon its passage. - 3 - PASSED AND APPROVED this the c 4Iday of 1967 .
