AN ORDINANCE AMENDING THE CODE OF ORDINANCES BY
ADDING SECTION 15-15 .1 WHICH AMENDS SECTIONS
16.63e, 28.1b, 28.9 AND 28. 10a, OF THE FIRE PRE-
VENTION CODE AS RECOMMENDED BY THE AMERICAN
INSURANCE ASSOCIATION, SUCCESSOR TO THE NATIONAL
BOARD OF FIRE UNDERWRITERS, BEING PARTICULARLY
THE 1965 EDITION THEREOF, PROVIDING FOR DELIVERY
OF FIVE (5) GALLONS OR LESS OF CLASS I AND II
FLAMMABLE LIQUIDS INTO SOUND METAL CONTAINERS,
WITH COVER AND SPOUT TO PREVENT SPILLAGE, RE-
QUIRING PERMITS FOR THE KINDLE AND MAINTAINING
OF FIRES AND APPROVAL OF THEIR LOCATION ON
PRIVATE LAND, REQUIRING TRASH TO BE BURNED IN
FIFTY-FIVE (55) GALLON FIREPROOF DRUMS WITH
HAIL SCREENS OVER TOP, REQUIRING FLAMMABLE DEC-
ORATIVE MATERIALS TO BE FLAMEPROOF, PREVENTING
THE TAKING OR MAINTAINING OF OPEN FLAMES OR
LIGHTS IN BUILDINGS USED BY THE PUBLIC, UNLESS
OPEN FLAMES OR LIGHTS ARE KEPT IN GLASS COVERS
OR OTHER APPROVED DEVICE, AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The Code of Ordinances of the City of
Wichita Falls is hereby amended by adding Section 15-15. 1 to
read as follows :
"Section 15-15. 1. Changes, deletions and amendments.
The following changes, deletions and amendments are
hereby made in the Fire Prevention Code adopted in Section
15-15:
(1) Subsection e. of Section 16. 63 is hereby amended
so that it shall read as follows:
' e. Dispensing containers. No delivery of any Class
I or II flammable liquids shall be made into portable containers
of five (5) gallon capacity or less unless the container is of
sound metal construction, has a tight closure with screwed or
spring cover and is fitted with a spout or so designed that the
contents can be poured without spilling. '
(2) Subsection b. of Section 28. 1 is hereby amended so
that it shall read as follows:
'b. Location restricted. No person shall kindle or
maintain any bonfire or rubbish fire or authorize any such fire
to be kindled or maintained on any private land unless : (1)
The location of such fire has been inspected, approved and a
burning permit issued by the Fire Marshal or his authorized
representative. (2) The location is in an area where there
is no sanitation pickup. (3) The trash is burned in a fifty-

five (55) gallon capacity drum that is of sound fireproof
construction and has a 1/4" block hail screen over the top
as directed by the Fire Marshal or his authorized representa-
tive. '
(3) Section 28.9 is hereby amended so that it shall
read as follows :
' Section 28.9. Flammable decorative materials. Highly
flammable materials such as cotton batting, straw, dry vines,
leaves, trees, artificial flowers or shrubbery and foam plastic
materials shall not be used for decorative purposes unless first
rendered flameproof in accordance with Section 27 .3. Electric
light bulbs shall not be decorated with paper or other combust-
ible materials unless such materials shall first have been ren-
dered flameproof. '
(4) Subsection a. of Section 28. 10 is hereby amended
so that it shall read as follows :
' a. Open flames or lights restricted. No person shall
take or maintain open flames or lights in a mercantile building,
business building, school building, institutional building,
hospital or other type of building and/or public assembly, barn,
vessel, or boat, unless such flames or lights shall be well
secured in a glass globe, wire mesh cage or similar approved
device. '"
SECTION 2 . The fact that many people live within the
City of Wichita Falls and there is an urgent need for protection
against fires, this ordinance is declared an emergency measure
on the ground of urgent public need for the preservation of the
peace, health and safety of life and property of the City and
said ordinance shall take effect immediately upon its passage.
