ORDINANCE AMENDING ORDINANCE NO. 3457 , WHICH
CONTROLLED THE ISSUANCE OF BUILDING PERMITS
FOR OTHER THAN SINGLE FAMILY RESIDENCES TO
CONFORM WITH DEED RESTRICTIONS , BY DELETING
SECTION 7 WHICH TERMINATED SUCH ORDINANCE IN
360 DAYS.
WHEREAS , on April 24, 1979, the Board of Aldermen
adopted Ordinance No. 3456, which authorized the City to file
suit to enforce land use restrictions, and Ordinance No. 3457
which controlled the issuance of building permits for other
than single family residences to conform with deed restrictions,
and each of these ordinances provided that they would be
automatically repealed 360 days after the date of adoption;
and,
WHEREAS, the Board of Aldermen desire to extend these
ordinances by removing the provision for automatic termi-
nation.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT :
Ordinance No. 3457 is hereby amended by deleting and
repealing therefrom Section 7, so that such ordinance shall
not be automatically repealed 360 days after its adoption.
As the voters of Wichita Falls defeated the Comprehensive
Zoning Ordinance on April 5, 1980, deed restrictions can only
be enforced by private parties after the expiration of Ordinance
No. 3456; enforcement of deed restrictions by the City is
deemed necessary for the preservation of the peace, health and
safety of property of the City, and this ordinance is declared
to be an emergency measure which shall become effective upon
the automatic termination of Ordinance No. 3456.
