ORDINANCE GRANTING AUTHORITY TO SOUTHWESTERN
BELL TELEPHONE COMPANY TO PLACE PUBLIC PAY
TELEPHONES ON SIDEWALKS IN WICHITA FALLS.
WHEREAS , Southwestern Bell Telephone Company has
requested authority from the City to place certain public
pay telephones on the sidewalks for the convenience of the
public and to be used for emergency calling, such phones to
be"dial tone first" , which means that emergency calls can be
made without depositing money; and,
WHEREAS, this program is at no cost to the City, and
the telephone company will pay to the City 10 per cent
commission on all monies in the boxes on such phones.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Southwestern Bell Telephone Company is hereby
granted the right and authority to place public pay telephones
on sidewalks in Wichita Falls at the following locations:
715, 817 , 1001 and 1201 Scott, 623, 1014 and 1301 Lamar,
700 and 826 Indiana, 801 and 1000 Travis, and 814 Austin;
in addition, the telephone company may place such phones at
other locations which are approved in writing by the City
Manager. The telephones shall be placed in housings known
as Sentry Rugged Enclosures.
SECTION 2. The telephone company shall co-ordinate such
project with the City Director of Public Works, City Director
of Public Utilities, and all utility companies whose facilities
are located in the sidewalk area.
SECTION 3. The telephone company shall pay to the City
10 per cent commission on all monies in the boxes in such
telephones.
SECTION 4. It shall be the responsibility of the telephone
company at all times to maintain said telephones, housing and
other appurtenances at its own expense. If at any in
the future some public use of such sidewalks makes it necessary
that the telephones and housings be relocated or removed,
such relocation or removal shall be done at the sole cost
and expense of the telephone company.
SECTION 5. Whenever any work is being done on the
construction or maintenance of said telephones, the telephone
company shall take all necessary and proper precautions to
protect the public from damages. The telephone company shall
hold and save the City of Wichita Falls harmless from all
damages or claims for damages resulting from the construction,
maintenance, operation and location of such telephones and
their housings and appurtenances .
SECTION 6 . The right and authority hereby granted is for so
long as the telephone company has a franchise to operate
within the City of Wichita Falls. At such time as the
telephone company' s franchise terminates, or at such earlier
time that the company ceases to use such telephones, they
shall be removed by the telephone company at its sole cost
and expense.
