AN ORDINANCE AMENDING THE COMPREHENSIVE SUBDIVISION ORDINANCE
NO. 2118, BEING APPENDIX A OF THE CODE OF ORDINANCES OF WICHITA
FALLS, TEXAS, ESTABLISHING THE AUTHORITY, PURPOSE AND AREA OF
SUBDIVISION REGULATIONS, AND ESTABLISHING THE REQUIREMENT OF
PLATTING OR P.EPLATTING PROPERTY
WHEREAS, tracts of land are being sold and such sales are being recorded
in the County deed records without having the property appropriately platted, and;
WHEREAS, such transactions result in the subdivision of land without the
review and approval of the Planning Board and are in violation of the Subdivision
Regulations, and;
WHEREAS, such transactions often result in unnecessary delay to the pur-
chaser of such property because a building permit cannot be issued until a plat
approved by the Planning Board is duly recorded with the County Clerk.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS THAT:
SECTION 1. Section 1. of Ordinance No. 2118, Appendix A, Code of
Ordinances, be amended to read as follows:
"SECTION 1. Authority, Purpose and Extraterritorial Application.
A. The provisions of Chapter 231, Acts of the 40th Legislature,
Regular Session, 1927, as heretofore or hereafter amended (compiled as
Article 974a, V.T.C.S.) and the provisions of Section 4 of the Municipal
Annexation Act as heretofore or hereafter amended (compiled as Article
970a, V.T.C.S.) are hereby adopted. This ordinance is adopted pursuant
to the provisions of the Charter of the City.
B. The purpose of this ordinance is to provide for the orderly,
safe, and healthful development of the area within the City and within
the extraterritorial jurisdiction of the City as described in Article
970a, V.T.C.S. , and to promote the health, safety and general welfare
of the community."
SECTION 2. SECTION 2. of Ordinance No. 2118, Appendix A, Code of
Ordinances be amended to read as follows :
"SECTION 2. Requirement of platting or replatting.
A. Whenever a subdivider desires to create a subdivision, as those
terms are defined herein, within the City or its extraterritorial juris-
diction, he shall plat the property, construct the site improvements,
and meet all of the other requirements of this ordinance.
B. Whenever the owner of two or more lots in a subdivision within
the City or its extraterritorial jurisdiction proposes to construct any
new building or other structure which will cross a lot line or violate
building setback requirements, such owner shall replat the lots in
accordance with this ordinance.

C. Whenever the owner of a tract of land, within the City or its
estraterritorial jurisdiction, which has not been platted in accordance
with applicable law proposes to sell such tract, or to construct or repair
any building or other structure thereon, or to connect said tract with
any public utilities owned or controlled by the City, he shall plat such
tract in accordance with this ordinance. Even though he plats such tract
as a single lot, he shall be required to dedicate the required boundary
street right-of-way and comply with all other applicable requirements
of this ordinance. Provided, however, the owner will not have to plat
the tract if such tract was subdivided from a larger tract no later than
December 31, 1927. However, if the tract was subdivided from a larger
tract on or after September 28, 1964, the larger tract must be platted
to show the smaller tract as a lot therein."
