ORDINANCE NO. -,:%' 74(� AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, BY ANNEXING CERTAIN LANDS ADJACENT TO THE TERRI- TORIAL LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, WHICH LANDS ARE DESCRIBED IN THIS ORDINANCE. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That the following tracts of land located in Wichita County, Texas, be and the same are hereby ordered to be annexed and to be included within the corporate limits of the City of Wichita Falls, Texas, and the corporate limits be extended so as to include said tracts of land in Wichita County, Texas, the same being more particularly described as follows: TRACT I BEING a tract of land out of the Cherokee County School Lands, A-33, Kemp & Newb y Subdivision, Blocks 16, 21, 26, and 27, Wichita County, Texas; said tract being more specifically described by metes and bounds as follows: BEGINNING at a point on the present city limits line at the south- western most corner of Tract II as described in Ordinance No. 1820, said point also being 130 feet east of the east right-of-way line of South Bandera Drive and located on the south lot line extended of Lot 12, Block 11, Sun Valley Addition; THENCE east, 1870 feet, along the present city limits line, said line also being the south boundary of said Tract II as described in Ordinance No. 1820 to a point for corner, said point also being on the west right-of-way line of McKinney Road; THENCE south, 200 feet, along the west right-of-way line of McKinney Road to a point for corner, said point also being the southwestern most corner of Tract VIII as described in Ordinance No. 2598; THENCE east, 3380 feet, along the present city limits line, said line also being the south boundary of said Tract VIII as described in Ordinance No. 2598, and being 200 feet south and parallel to the south right-of-way line of Quincy Road, to a point for corner on the west right-of-way line of Hammon Road; THENCE north, 530 feet, along the west right-of-way line of Hammon Road to a point for corner, said point being the intersection of the west right-of-way line of Hammon Road and the southwestern corner of the tract of land described by Ordinance No. 2331; THENCE east, 120 feet to a point for corner on the east right-of-way line of Hammon Road; THENCE S 010 01' 26"W, 1207 feet along the east right-of-way line of Hammon Road to a point for corner, said point being the intersection of the said right-of-way line and the north survey line of Block 27, Kemp and Newby Subdivision; -2- THENCE west 43 feet more or less, along the north survey line of Block 27, Kemp and Newby Subdivision to a point for corner, said point also being on the east right-of-way of Hammon Road; THENCE south 18 feet more or less, along the east right-of-way of Hammon Road to a point for corner, said point also being on the south boundary extended easterly of Lot 8, Block 1, Summit View Estates, an addition to the City of Wichita Falls, Texas; THENCE west 861 feet, passing the west right-of-way line of Hammon Road and along the south boundary of Lot 8, Block 1 Summit View Estates to a point for corner, said point also being the southwest corner of said lot; THENCE north, 103 feet, along the west lot line of said Lot 8, Block 1, Summit View Estates Subdivision to a point for corner, said point being the southeast most corner of Lot 7, Block 1, Summit View Estates Subdivision; THENCE west 2327 feet along the south lot lines of Lots 1-7, Block 1, Summit View Estates Subdivision to a point for corner, said point being 200 feet east of the east right-of-way line of McKinney Road; THENCE S 00° 19' W, 1329 feet, along a line parallel and 200 feet east of the east right-of-way line of McKinney Road to a point for corner, said point being located on the south survey line of Block 16, Kemp and Newby Subdivision; THENCE N 89° 49' W, 2120 feet, to a point for corner, said point being 1585 feet east of the southwest corner of Block 16, Kemp and Newby Subdivision; THENCE north, 2125 feet, to the place of beginning, containing 147 acres more or less. -3- TRACT III BEING a tract of land out of the Robert Evans Survey, A-74, Wichita County, Texas, said tract being more specifically described by metes and bounds as follows: BEGINNING at the point of intersection of the centerline of Turtle Creek Ranch Road and the north right-of-way line of Ridgemont Drive extended, said point also being on the city limits line described by Ordinance 1909; THENCE south 890 feet, along the centerline of Turtle Creek Ranch Road to a point, said point also being on the city limits line described by Ordinance 1909; THENCE S 37° 08' W, 151 feet, along the centerline of Turtle Creek Ranch Road to a point, said point also being on the city limits line described by Ordinance 1909; THENCE S 00° 29' E, 235 feet, along the centerline of Turtle Creek Ranch Road to a point for corner, said point being at the intersection of the present city limits line and the north right-of-way line of Anchor Road extended; THENCE in a northwesterly direction past the west right-of-way line of Turtle Creek Ranch Road at 80 feet and along the north right-of- way line of Anchor Road to a point for corner, a total distance of 1320 feet, said point also being the east right-of-way line of Fort Worth & Denver Railroad (F.W.&D.RR.) ; THENCE along the east right-of-way line of said Fort Worth & Denver Railroad in the following manner: North, 225 feet, East, 25 feet, North, 305 feet, East, 31 feet, North, 83 feet to a point of intersection with the southwest most corner of Cimarron Subdivision, N 03° 51' E,, 122 feet, N 87° 53' 41�� W, 45 feet, N 02 22' 25" E, 298 feet, N 89° 31' W, 10 feet, N 00° 00' 31" N, 1138 feet to a point for corner; THENCE S 89° 55' 32" E, 1440 feet, to a point located on the east right- of-way line of Turtle Creek Ranch Road; THENCE along the east right-of-way line of said Turtle Creek Ranch Road in the following manner: S 16° 28' 38" W 553 feet, S 04° 58' 39" W 157 feet, S 08° 03' E 404 feet, S 01° 45' E 95 feet to a point for corner at the intersection of the east right-of-way line of said Turtle Creek Ranch Road and the north right-of-way line of Ridgement Drive; THENCE 76° 12' W 30 feet along an extension of the north right-of-way line of said Ridgemont Drive to the place of beginning and containing 71 acres, more or less. -4- SECTION 2. In conformity with Section 6 of Article 970a of the Revised Civil Statutes of Texas, before these annexation proceedings were instituted, the Board of Aldermen called a public hearing on November 4, 1980 to provide an opportunity for all interested persons to be heard; notice of such hearing was published once in the Wichita Falls Record News not more than twenty (20) days nor less than ten (10) days prior to the public hearing. Such public hearing was held on November 4, 1980 which was not more than twenty (20) days nor less than ten (10) days prior to the institution of the annexation proceedings. SECTION 3. In conformity with Section 3-A of the amended Charter of the City of Wichita Falls, Texas, this ordinance is on the 18th day of November, 1980 introduced and the City Clerk is directed to publish said ordinance one (1) time in a newspaper of general circulation published in the City of Wichita Falls, Texas, and seven (7) days thereafter this ordinance may be finally acted upon. SECTION 4. The fact that this is an urbanizing area, and City safety, health and police controls and measures will be needed, creates an emergency, and it is hereby declared that this ordinance is an emergency measure on the grounds of public need for the preservation of the peace, health, and safety of property of the city, and this ordinance shall go into effect immediately upon its passage. This ordinance having been introduced on the 18th day of November, 1980 and having been published in a newspaper of general circulation in the City of Wichita Falls, Texas to wit, the Wichita Falls Record News, one (1) time, on the 21st day of November, 1980 and seven (7) days after such publication having elapsed, this ordinance is finally passed and approved this the 2nd day of December , 1980.
