ORDINANCE CLOSING, VACATING, AND ABANDONING THAT
PORTION OF EAST FORT WORTH STREET NORTH OF LOT 1,
BLOCK 13 , KEMP & NEWBY SUBDIVISION, BETWEEN THE
EAST AND WEST PROPERTY LINE THEREOF, WICHITA
FALLS, TEXAS.
WHEREAS, the Planning Board has recommended that a portion of
East Fort Worth Street north of Lot 1, Block 13 , Kemp & Newby
Subdivision, be closed subject to final platting; and,
WHEREAS, the City Council of the City of Wichita Falls, Texas,
deems it advisable and in the public interest to close, vacate, and
abandon the utility easement hereafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS , TEXAS, THAT:
SECTION 1. A portion of East Forth Worth Street lying north of
Lot 1, Block 13 , Kemp & Newby Subdivision, Wichita Falls, Wichita
County, Texas, said street being specifically described by metes
and bounds as follows :
BEGINNING at a 1/2 inch iron road at
the intersection of the west right-
of-way line of Old Windthorst Road and
the south right-of-way line of East Fort
Worth Street, said 1/2 inch iron rod
being the southeast corner and PLACE OF
BEGINNING of this description;
THENCE South 88° 54 ' West along the
south right-of-way line of East Fort
Worth Street, also being the north
property line of the above-mentioned
Lot 1 , Block 13 , a distance of 200. 00
feet to a 1/2 inch iron rod for the
southwest corner of this tract;
THENCE North 00° 18 ' West 50 .01 feet to
a 1/2 inch iron rod lying in the north
right-of-way line of East Fort Worth
Street for the northwest corner of this
tract;
THENCE North 88° 54 ' East along said
north right-of-way line, a distance of
199 . 67 feet to a 1/2 inch iron rod for
the northeast corner of this tract;
THENCE South 00° 41 ' East, 50. 00 feet
to the PLACE OF BEGINNING and containing
0 . 23 acres of land, more or less.
be and the same is closed, vacated, and abandoned.
SECTION 2 . The closure shall become effective upon Meads
Foods, Inc. , meeting the following conditions:
1) Provide utility easements over existing water and sewer
lines as required by the Public Utilities Department.
2) Provide a twenty (20) foot wide utility easement over an
existing gas line.
3) Provide drainage improvements as approved by the Director
of Public Works .
4) Perigo Street will be widened by Meads Foods at the
southeast corner of the intersection with East Fort Worth Street.
5) A vehicular turn-around will be constructed by Meads
Foods to the west of the street closure.
