ORDINANCE AMENDING SECTIONS 111.1 , 111 .2 AND
111 .3 OF THE STANDARD BUILDING CODE ADOPTED
BY SECTION 7-14 OF THE CODE OF ORDINANCES OF
THE CITY OF WICHITA FALLS, TO CHANGE THE NAME
OF THE BOARD OF ADJUSTMENTS AND APPEALS , TO
INCREASE THEIR NUMBER, AND TO MODIFY THE TERMS
OF OFFICE AND QUORUM.
WHEREAS, Section 111 of the Standard Building Code establishes
the Board of Adjustments and Appeals, which shall consist of five
members, serving terms of four years , with three members constituting
a quorum; and,
WHEREAS, such Board has requested that certain changes be made
concerning the Board' s name, its number, the terms of office and
quorum, and the City Council finds that such changes are advisable.
NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS , THAT:
Sections 111. 1, 111 . 2 and 111. 3 of the Standard Building Code,
as adopted by Section 7-14 of the Code of Ordinances of the City of
Wichita Falls, are hereby amended to read as follows :
"Section 111.1 - Appointment
There is hereby established a board to be called the Building
Code Board of Adjustments and Appeals, which shall consist of seven
(7) members. Such board shall be composed of two (2) Architects,
two (2) General Contractors and/or Engineers and three (3) members
at large from the building industry other than architects. The
said Board shall be appointed by the Chief Appointing Authority.
All references in this text to the Board of Adjustments and Appeals
shall mean the Building Code Board of Adjustments and Appeals.
Section 111. 2 - Term of Office
Of the members first appointed, four (4) shall be appointed
for a term of one (1) year and three (3) for a term of two (2)
years; thereafter, they shall be appointed for terms of two (2)
years. Terms shall expire on December 31. At the end of his
term, a member shall continue to serve until his successor is
appointed and qualified.
Vacancies shall be filled for an unexpired term in the
manner which original appointments are required to be made.
Continued absence of any member from regular meetings of the
Board shall, at the discretion of the Chief Appointing Authority,
render any such member liable to immediate removal from office.
Section 111. 3 - Quorum
Four (4) members of the Board shall constitute a quorum.
In varying the application of any provisions of this code or in
modifying an order of the Building Official, affirmative votes of
the majority present, but not less than four (4) affirmative
votes shall be required. A board member shall not act in a case
in which he has a personal interest. "
