ORDINANCE ADOPTING A SYSTEM OF REPRESENTATION
BASED ON SINGLE-MEMBER DISTRICTS AND A MAYOR
AND ONE COUNCILMAN ELECTED AT LARGE; SPECIFYING
THE TERMS AND YEARS OF ELECTION; DESCRIBING THE
BOUNDARIES OF THE DISTRICTS; PROVIDING FOR
COUNCILMEN AND THE MAYOR TO BE ELECTED BY A
PLURALITY VOTE; PROVIDING AN EFFECTIVE DATE;
DECLARii. ' AN EMERGENCY.
WHEREAS, the City of Wichita Falls is presently involved in
litigation in the United States District Court for the Northern
District of Texas , Wichita Falls Division, in a case numbered
CA 7-84-133 , styled "Raul Vasquez , et al, vs. City of Wichita
Falls, Texas , et al" ; and,
WHEREAS , the City of Wichita Falls and the Plaintiffs have
negotiated a settlement of the pending litigation without the
admission of liability of either party, but in complete settlement
of all issues of law and fact; and,
WHEREAS , part of the compromise between the parties is the
change of the election process in the City of Wichita Falls by
providing for five "single-member" districts, with the qualified
voters of each district voting only for the resident candidate
for the council position in their district; and further providing
for a Mayor and one councilmember who will be elected "at large"
by all qualified voters of the City of Wichita Falls .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . Definitions .
a. "City Council" means the City Council of the City of
Wichita Falls, Texas .
b. "Ward" means district.
c. "City" means City of Wichita Falls, Texas.
SECTION 2 . The City Council shall be composed of a Mayor
and six councilmen. The Council does hereby establish five (5)
"single member" wards, being numbered one through five inclusive,
and as identified on the map (Exhibit A) and the accompanying
field notes (Exhibit B) attached hereto and expressly incorporated
by reference herein. Any person seeking election to any particular
numbered district shall be a bona fide resident of the City and
the district which he seeks to represent. Any person seeking
election to the position of Mayor or the one "at large" council
seat shall be a bona fide resident within the corporate limits
of the City of Wichita Falls .
SECTION 3 . If , during the term of his or her office, a
councilman from one of the five (5) numbered council wards
ceases to be a bona fide resident of the City or of the council
ward from which that individual has been elected, that office
shall become vacant and the vacancy shall be filled as specified
in the City Charter. If , during the term of his or her office , the
Mayor or the one councilman elected "at large" ceases to be a
bona fide resident within the corporate limits of the City of
Wichita Falls, that office shall be vacant and the vacancy
likewise filled as specified in the City Charter.
SECTION 4 . The City Council shall be composed of a Mayor
and six councilmen. The Mayor and one councilman shall be
elected from the City "at large" ; the other five councilmen shall
be elected from the five single member districts. Any candidate
for councilman from a district must receive a plurality of the
voates cast for the district in which he resides . The Mayor and
the councilman "at large" must each receive a plurality of the
votes cast in the entire City.
SECTION 5 . The Mayor and each councilman, upon election,
shall serve a term of two years, unless otherwise specified herein,
and shall continue to serve until his successor is duly elected,
and sworn into office.

SECTION 6 . To implement the system of single-member
representation and insure an orderly transition:
a. District One, District Two and the councilman at-large ' s
position, will stand for regular election in 1985 and each odd
year thereafter.
b. District Three, District Four, District Five and the
Mayor' s position will stand for regular election in 1986 and each
even year thereafter.
c. Bill Palmer shall serve as the resident representative
of District Three until a successor qualifies by election in
1986 , or otherwise. Craig A. Wilson shall serve as the resident
representative of District Four, until a successor qualifies by
election in 1986 , or otherwise . James A. Welburn will serve as
the resident representative of District Five until a successor
qualifies by election in 1986 , or otherwise . Gary D. Cook will
until a successor qualifies by election in 1986 ,

SECTION 7 . The terms of councilmen Thomas E. Swift, Charles
Harper, and Charles Dean Thomas shall terminate after the
election in 1985 , and their successor is duly elected and sworn
into office .
SECTION 8 . This ordinance and the specific plan of
redistricting as set out herein, shall not become effective until
they have received preclearance by the Attorney General of the
United States of America, as required in Section 5 of the Voting
Rights Act of 1965 , as amended in 1982, United States Code
Annotated, nor until they have further been held constitutional
by the United States District Court for the Northern District of
Texas .
SECTION 9 . The provisions of this ordinance shall prevail
over any conflicting provisions in any other ordinance of the
City or any provision of the Home Rule Charter of the City.
SECTION 10 . The fact that approval of the proposed change
in the system of representation of City is needed at the earliest
possible date to insure all necessary conditions and requirements

are met prior to the next official officers election in 1985,
makes it necessary for the immediate preservation of the public
health, safety and general welfare of the public, creates an
emergency and this ordinance is hereby declared to be an
emergency measure, and this ordinance shall be in full force
and effect immediately upon its passage, subject to the provisions
of Section 8 . of this ordinance.
