Ord 51-85 5/21/1985 . • ORDINANCE NO. 51-85 AN ORDINANCE AMENDING CHAPTER 2, ARTICLE IV, DIVISION 1 OF THE CITY OF WICHITA FALLS CODE OF ORDINANCES CHANGING THE PLANNING BOARD TO THE PLANNING AND ZONING COMMISSION, AND DECLARING AN EMERGENCY WHEREAS, the City Council of the City of Wichita Falls has adopted a Zoning Ordinance; and, WHEREAS, the Zoning Ordinance establishes the Planning Board as also functioning as the Zoning Commission. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Chapter 2, Article IV, Division 1 of the City of Wichita Falls Code of Ordinances is hereby amended to read as follows: "DIVISION 1. PLANNING AND ZONING COMMISSION Sec. 2-133. Created. There is hereby created a Planning and Zoning Commission for the city composed of nine (9) members, each of whom shall be a resident of the city, and who shall serve without pay. Sec. 2-134. Appointment, term, chairman, vice-chairman and City Council representative. The City Council shall appoint members of the Planning and Zoning Commission. The terms of such members shall be for a period of three (3) years, and thereafter until their successors are appointed. However, the terms shall be so staggered that one-third (1/3) of the commission shall be appointed each year. The former Planning Board members shall serve out their unexpired terms. The City Council shall nominate one of the members as chairman, and the chairman shall appoint a vice-chairman, both of which will serve not more than two (2) consecutive one-year terms in their respective offices. The length of service by any member of the Planning and Zoning Commission shall be not more than six (6) consecutive years; however, a member may be reappointed to the Commission after an absence of three (3) years. The mayor shall also appoint a member of the City Council to serve as a representative to the Plan- ning and Zoning Commission. The representative should attend all official Planning and Zoning Commission meetings and work sessions, but shall be ex officio and nonvoting. The term of office of each member shall commence upon the appointment by the City Council, and shall terminate on May 31 of the proper year. -2- Sec. 2-135. Vacancies and removal from office. All vacancies shall be filled by appointment of the City Council and shall be for the remainder of the term of the vacating member. Any member of the Planning and Zoning Commission may be removed from his/her office at any time by a five-seventh (5/7) majority vote of the City Council, and no reason need be given for such removal. Sec. 2-136. City officials to cooperate with commission. All department directors and officials of the city shall be available to the Planning and Zoning Commission for advice and consultation, and they shall cooperate with and render such services for the Commission as shall come within the scope of the duties of such department directors and officials. All such department directors and officials shall attend meetings of the Planning and Zoning Commission upon the written request of the Commission or its duly author- ized official. Sec. 2-137. Quorum. For the purpose of transacting any business five (5) members of the Planning and Zoning Commission shall constitute a quorum, and all actions of the Commission shall be approved by a vote of the majority of the members present, but in no case shall less than five (5) affirmative votes be effective to carry any action of the Commission. Sec. 2-138. Powers and duties. The Planning and Zoning Commission shall have the power and it shall be its duty: (1) To study the developing housing and commercial trends and make recommen- dations to the City Council, and particularly shall pass upon the application for plats requested for approval. (2) To make plans and maps of the whole or any part or portion of the city and of land outside the city located within the extraterritorial jurisdiction of the city and any other land outside the city which, in the opinion of the Planning and Zoning Commission, bears a relation to the planning of the city and to make changes in, additions to, and extensions of such plans or maps when it deems the same advisable. -3- (3) To select and recommend to the City Council routes of streets, avenues and boulevards, including the opening, widening and abandoning of the same, or of any alley, or the changing thereof to conform with the city's system, present and future, with reference to traffic. (4) To suggest to the City Council plans for clearing the city of slums and blighted areas. (5) To review and take action on appeals to the Site Plan Review Procedure of the Zoning Ordinance. (6) To conduct public hearings, review and take action on a Conditional Use Permit application of the Zoning Ordinance. (7) To conduct public hearings on any applications or proposals for any amendment, supplement, or other change to the Zoning Ordinance and Subdivision Ordinance, and make recommendations to the City Council. (8) To act with and assist all other municipal and governmental agencies, and particularly the City Council, in formulating and executing proper plans of municipal development and growth including annexation and disannexation." SECTION 2. The fact that the Zoning Ordinance shall become effective on May 23, 1985, creates an emergency, and implicitly requires that this ordinance shall become effective on that date.
