ORDINANCE NO. 65-85
ORDINANCE AMENDING SECTIONS 20-11 AND 20-12
OF THE CODE OF ORDINANCES TO EXTEND CURFEW
HOURS FOR MINORS TO 12 :00 A.M. ON MONDAY
THROUGH FRIDAY; 1: 30 A.M. ON SATURDAY AND
SUNDAY; AND 1: 30 A.M. ON WEEKDAYS WHEN MAN-
DATORY PUBLIC SCHOOLS ARE NOT IN SESSION.
WHEREAS, Section 20-11 of the Code of Ordinances makes it
unlawful for persons under the age of 18 years to loiter, idle, wander,
stroll, or play in or upon the public streets, highways, roads, alleys,
parks, playgrounds or other public grounds, public places and public
buildings, places of amusement and entertainment, from 11: 00 p.m.
to 4 : 00 a.m. on Sunday through Thursday, 12: 30 a.m. to 4 : 00 a.m. on
Friday and Saturday, or on days when there is no mandatory public
school in session the following day; and,
WHEREAS, wholesome entertainment and innocent night-time acti-
vities, such as movies and dances, are being offered with increasing
frequency; and,
WHEREAS, a slight extension of curfew hours is desired to
enable young persons to attend such activities; and,
WHEREAS, Section 20-12 of the Code of Ordinances makes it unlaw-
ful for a parent, guardian, or other adult having custody of a minor
to knowingly permit a minor to violate the curfews set in Section
20-11.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
Sections 20-11 and 20-12 of the Code of Ordinances shall be
amended to read as follows :
Sec. 20-11. Loitering of minors -- Prohibited.
It shall be unlawful for any minor under the age of eighteen
( 18 ) years to loiter, idle, wander, stroll or play in or upon the
public streets, highways , roads, alleys, parks , playgrounds, or
other public grounds , public places and public buildings, places
of amusement and entertainment, vacant lots , or other unsupervised
places, between the hours of 12: 00 a.m. and 4: 00 a.m. on Mondays,
Tuesdays, Wednesdays , Thursdays, and Fridays, and between the
hours of 1 : 30 a.m. and 4 : 00 a.m. on Saturdays and Sundays; pro-
vided that on any day on which the mandatory public schools of
the city are not in session, the provisions of this section do
not apply, and such hours are hereby extended to 1 : 30 a.m. and
4: 00 a.m. on such day; provided, however, that the provisions of
this section do not apply to a minor accompanied by his or her
parent, guardian or other adult person or where the minor is upon
an emergency errand or legitimate business directed by his or her
parent, guardian or other adult person having the care and custody
of such a minor.
Sec. 20-12 . Same -- Responsibility of parents.
It shall be unlawful for the parent, guardian or other adult
person having the care and custody of a minor under the age of
eighteen ( 18) years, to knowingly permit such minor to loiter,
idle, wander, stroll or play in or upon the public streets , high-
ways, roads, alleys, parks , playgrounds, or other public grounds ,
public places and public buildings, places of amusement and
entertainment, vacant lots, or other unsupervised places, between
the hours of 12: 00 a.m. and 4: 00 a.m. on Mondays , Tuesdays,
Wednesdays , Thursdays, and Fridays, and between the hours of
1 : 30 a.m. and 4: 00 a.m. on Saturdays and Sundays; provided, however,
that on any days on which the mandatory public schools of the city
are not in session, the provisions of this section do not apply,
and such hours are hereby extended to 1 : 30 a.m. and 4: 00 a.m. on
such days; provided, however, that the provisions of this section
do not apply when the minor is accompanied by his or her parent,
guardian, or other adult person having the care and custody of
the minor.
