Ord 120-85 11/5/1985 ORDINANCE NO. 120-85 AN ORDINANCE REZONING 16.1 ACRES OF LAND FROM LIMITED AND GENERAL COMMERCIAL (LC AND GC) TO A PLANNED UNIT DEVELOP- MENT (PUD) ZONING DISTRICT WHEREAS, the proposed rezoning of 16.1 acres of land generally located between 5th and 9th Streets, Morningside Park Addition and Deaton-Waggner Subdivision from LC and GC to PUD #R-85-8 is in accordance with the City's Comprehensive Land Use Plan; and, WHEREAS, the City Council of the City of Wichita Falls, Texas deems it advisable and in the public interest to rezone the said 16.1 acres of land hereafter described to Planned Unit Development (PUD) #R-85-8 zoning district. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The 16.1 acres of land shown as the grey shaded area on the attached map (Attachment 1) is hereby rezoned from Limited Commercial and General Commer- cial to Planned Unit Development #R-85-8 subject to the development standards and conditions listed in Attachment 2 and the site plan shown in Attachment 3. ATTACHMENT 2 DEVELOPMENT STANDARDS AND CONDITIONS FOR PUD R-85-8 Land Use The land use of this PUD will be limited to an indoor sports complex, offices, and retail commercial areas as shown on the attached site plan. No outdoor recreational facilities shall be allowed. Access & Circulation Access for all phases of the PUD must be obtained from 5th Street. No ingress or egress shall be allowed in this development from 9th Street or Sturdevandt Place. All driveways, interior streets, and circulation patterns shall be designed to meet city standards, and State Highway Department approval shall be required for the 5th Street entrance. Parking All parking spaces, aisle deminsions, loading zones shall conform to city standards. Any shared parking arrangements must be approved by the City Planning Dept. Improvement Heights & Layouts No building, sign or site improvement shall exceed 1,000' MSL. Only structures denoted by a building outline on the site plan may be constructed. Signs Only wall signs and ground signs will be permitted on the site south of the original GC boundary. Off-premise and roof signs shall not be allowed on site. No signs shall be placed on the east side of the proposed sports complex building. Signs shall not exceed 1,000'MSL in height. In addition, flashing signs are prohibited, and all other lighting shall be directed away from residential uses. Buffering A 6' privacy fence shall be provided and maintained along the & Screening east and south property lines. All mechanical equipment shall be buffered and screened for sight and sound. Lighting All lighting associated with this project shall be directed away from residential uses. Hours of Operation Commercial activities on this site shall be restricted to between 6 a.m. to midnight. Alcoholic Beverage Sales Such sales shall be permitted as an on-premise incidental use only. Setbacks The minimum setback from property lines abutting SF-1, SF-2 and MHR zones shall be 30' . The minimum setbacks from property lines adjacent to commercial zones shall be 5' . The minimum front setback along 5th Street shall be 25' . Landscaping Landscaping shall be provided and maintained according to a landscape plan. The landscape plan for each phase of the development must be submitted bearing the seal of a registered landscape architect, which must be approved by the Planning Department. This plan shall include irrigation as required by the Zoning Ordinance and meet the objectives of providing substantial buffering to the adjacent residential areas as well as providing an aesthetic environment. The areas east of the sports complex building shall not be covered by any impervious materials. Drainage Drainage improvements and retaining walls must be installed according to a plan submitted by a registered professional engineer bearing his seal and approved by the Director of Public Works. Platting The PUD must be platted as one lot. Provisions for transferring ownership of the remnant parcels on the south side of the property must be accomplished prior to final platting. An access easement to Blk 4 of the Deaton Waggoner Subd, Sec 2, must also be shown on the final plat. Utilities All utility lines shall be underground. Covenants Covenants for the title, responsibility, and maintenance of common areas, including parking areas must be submitted at the time of final platting and approved by the City Attorney. These covenants shall be filed for record at the time of final platting.
