Ord 146-85 12/3/1985 ORDINANCE NO. 146-85 AN ORDINANCE GRANTING THE TEXACO FOOD MART AT 1418 11TH STREET A VARIANCE FROM THE 300 FEET SEPARATION REQUIRE- MENT BETWEEN THE SALE OF ALCOHOLIC BEVERAGES AND A CHURCH WHEREAS, Section 109.33(e) of the Texas Alcoholic Beverage Code allows the governing body of a city to grant variances if the intended purpose of the 300 feet separation between the sale of alcohol and a church is not necessary; and, WHEREAS, the St. Paul Lutheran Church has voted to allow the Texaco Food Mart at 1418 11th Street to sell beer and wine; and, WHEREAS, the Texaco Food Mart is located in a General Commercial zone and the City Council of the City of Wichita Falls deems that granting of the variance will not adversely impact the health, safety, and welfare of the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: A variance is granted from Section 5430A of the Zoning Ordinance to allow Off-premise Beer and Wine Sales at the Texaco Food Mart located at 1418 11th Street, Wichita Falls, Texas.
