ORDINANCE NO. 46-2017_
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS ORDERING AND GIVING NOTICE OF A RUNOFF
ELECTION, PROVIDING FOR A RUNOFF ELECTION TO BE HELD
DECEMBER 9, 2017; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO
THE PUBLIC AS REQUIRED BY LAW
WHEREAS, the City Council of the City of Wichita Falls, Texas called an
election for City Officers to be held in the City on November 7, 2017, to elect a
Councilor at Large, a Councilor District 1, and a Councilor District 2; and,
WHEREAS, the election results were canvassed by the City Council and no one
candidate received a majority of all votes cast for the office of Councilor at Large; and,
WHEREAS, Section 21 of the City Charter provides that a runoff election must
be called for the purpose of determining the election between the two candidates who
received the highest and second highest number of votes ; and,
WHEREAS, in the Councilor at Large election, Bobby Whiteley received 49.4 %
of the votes cast, Penny Miller received 21.82% of the votes cast, Brendan Bell
received 20.6% of the votes cast, and Charles Barr received 8.18% of the votes cast in
the November 7, 2017 Municipal Election.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. A Runoff Election is hereby ordered to be held December 9, 2017
for the purpose of resolving the election for Councilor at Large between Bobby
Whiteley and Penny Miller.
SECTION 2. Early Voting by personal appearance for the December 9, 2017
Runoff Election will be conducted at the Memorial Auditorium, 1300 7th Street,
beginning on Wednesday, November 22, 2017 and continuing through Tuesday,
December 5, 2017, during the hours set out below:
November 22 (Wednesday) 8:00 a.m. to 5:00 p.m.
November 27 – December 1 (Monday – Friday) 8:00 a.m. to 5:00 p.m.
December 4-5 (Monday-Tuesday) 7:00 a.m. to 7:00 p.m.
Branch early voting polling places will be at Home Depot, 3705 Kell Blvd, and at
Sikes Senter Mall during the hours set out below:
November 27 – December 1 (Monday – Friday) 10:00 a.m. to 7:00 p.m.
December 4-5 (Monday – Tuesday) 9:00 a.m. to 9:00 a.m.
SECTION 3. Applications for early voting ballot by mail shall be mailed to: Tracy
Norr, Early Voting Clerk, P.O. Box 1431, Wichita Falls, Texas 76307 to be received no
later than the close of business on November 28, 2017.
SECTION 4. Polling locations where qualified voters may cast bal lots for the
Runoff Election are as shown in Exhibit “A” attached hereto and made part hereof for
all purposes. The polling locations shall be open from 7:00 a.m. to 7:00 p.m. the date
of the election.
SECTION 5. It is hereby officially found and det ermined that the meeting at
which this Ordinance was passed was open to the public as required by law.
