RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS,
TEXAS, APPROVING AN AGREEMENT WITH CLUB CART FOR THE
CANCELLATION OF A LEASE FOR GOLF CARTS AND APPROVAL OF A
NEW LEASE UPON COMPLETION OF THE RENOVATION; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS
PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, The City of Wichita Falls has approved a construction contract for
the renovation of Weeks Park Golf Course; and
WHEREAS, The City of Wichita Falls is currently leasing golf carts from Club
Cart; and
WHEREAS, The current fleet of carts is not being used, and the City wishes to
cancel the current lease.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The attached agreement with Club Cart canceling the current lease
and agreeing to future terms of new lease is hereby approved.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.

AN AGREEMENT BETWEENT CLUB CAR, INC., A DIVISION OF INGERSOLL RAND (hereinafter
"Club Car") AND THE CITY OF WICHITA FALLS, TX (hereinafter "the City") FOR THE FUTURE
LEASE OF GOLF CARTS AT THE COMPLETION OF THE RENOVATION AT WEEKS PARK GOLF
COURSE
Whereas, the City is currently leasing 65 golf carts from Club Car for use at Weeks Park Golf Course; and
Whereas, the Governing Body of the City has accepted a bid and awarded contract for the renovation of Weeks Park
Golf Course; and
Whereas, the golf carts supplied and leased from Club Car will not be needed during the renovation; and
Whereas, the City wishes to discontinue the lease; and
Whereas, Club Car desires to do business with the City after the renovation to Weeks Park Golf Course.
Now Therefore, Be It Resolved by both parties the following terms and conditions apply:
Section 1, Existing Lease — The current lease between the City and Club Cart, dated June 6, 2005 and as authorized
by the Governing Body of the City on May 5, 2005 is hereby terminated. Club Cart agrees to take possession of the
existing fleet of golf carts, and all charges and fees associated with the existing lease are terminated.
Section 2, Future Lease — Club Cart agrees to provide 65 golf carts, with 30 days notice from the City, no fewer than
five days prior to a Grand Opening event. The terms of this lease will be 48 months, with a monthly payment of
$52.11 per cart, per month. Should the city elect to purchase the fleet from Club Cart at the conclusion of the term,
the cost will be $1,000 per golf cart.
Section 3, Provision of A Lease Document — Upon notice by the City, Club Cart agrees to provide the city with a
bona-fide lease agreement detailing the terms and conditions of such lease. Upon receipt, the City agrees to approve
the lease.
This Agreement shall be binding upon the parties hereto, their successors, heirs, personal representatives
and assigns.
IN WITNESS WHEREOF, the parties have executes this agreement on the dates indicated below.
