RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN
INTERLOCAL AGREEMENT WITH THE WICHITA FALLS
INDEPENDENT SCHOOL DISTRICT FOR THE PURCHASE OF
CERTAIN SUPPLIES, EQUIPMENT AND SERVICES; DETERMINING
THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED
WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls and Wichita Falls Independent School
District manage multiple bids that are issued and awarded throughout the year; and
WHEREAS, pursuant to the authority granted by Article 791 et seq. of the
Interlocal Cooperation Act, Local Government Entities may enter into interlocal
agreements for the purchase of supplies, equipment and services, and
WHEREAS, the City of Wichita Falls and the Wichita Falls Independent School
District desire to enter such an agreement, the goal being to obtain cost savings and
reduce time.
.NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Authorization is granted for the City Manager to execute an
interlocal agreement with the Wichita Falls Independent School District for the purchase
of certain supplies, equipment and services.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution as passed was open to the public as required by law.

This Agreement is entered into by and between the Agencies shown below as
contracting parties beginning May 1, 2007.

Authoritv for A�reement
The Citv of Wichita Falls and Wichita Falls Independent School District manage multiple bids that are
issued and awarded throughout the year. (Section 791.011 of the Texas Government Code grants Authority
for this agreement) The goal of this agreement is to obtain substantial savings and reduced time for the
City of Wichita Falls, Texas and Wichita Falls Independent School District to access and utilize each
entity's bids.
Responsibilitv of Citv of Wichita Falls and Wichita Falls Indeaendent School District
The City of Wichita Falls shall allow Wichita Falls Independent School District access to their bids in
response to their request. Wichita Falls Independent School District agree to manage these specified
existing contracts directly with the vendors for their immediate needs with no assistance or further cost
from the City of Wichita Falls.
The Wichita Fails Independent School District shall allow the City of Wichita Falls access to their bids
in response to their request. The City of Wichita Falis agree to manage these specified existing contracts
directly with the vendors for their immediate needs with no assistance or further cost from Wichita Falls
Independent School District.
Each entity will not be responsible for warranties, quality, quantities, failure to deliver by vendors, or
failure of payment to vendors by the other party.
Each entity agrees to pay the suppliers for all services, goods, equipment and products pursuant to this
agreement. The successful bidder shall bill the Contracting Entity directly far all services and items
purchased, and each contracting entity shall be responsible for vendor's compliance with all conditions of
delivery and quality of the purchased services and items.
Either party may terminate this agreement in writing to the other party within thirty-days prior written
notice to the other entity.
Authorization
The authorized representatives of City of Wichita Falls and Wichita Falls Independent School District
enter into the above-described agreement beginning May 1, 2007.
