Ordinance Closing An Alley Consisting Of Approximately 7,500
Square Feet In The 1300 Block Of Lamar Street (in Block 215 of the
Original Townsite), and authorizing the City Manager to execute all
documents necessary to retain an easement over said area
WHEREAS, The Kemp Center For The Arts has plans to expand with a three
floor, 1,008 square foot addition to the current building located at 1300 Lamar Street,
Block 215, Original Townsite, as indicated on the attached Location Map, and
construction will be facilitated by platting said block as a single lot, which in turn
requires the alley to be closed prior to the plat being approved,
WHEREAS, all affected utility companies and City departments have reviewed
this request and have recommended approval to close this alley with the condition that
the area to be retained as a sanitary sewer utility easement; and
WHEREAS, it has been determined to be in the best public interest to close said
alley to enable the building expansion as planned.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The approximately 7,500 square foot alley located in the 1300 block of Lamar
Street, (in Block 215 of the Original Townsite depicted in the attached Plat Map), is
hereby closed, with the property to be held by the City of Wichita Falls, albeit not as an
alley right-of-way, subject to a sanitary sewer easement to be retained therein. The
City Manager is authorized to execute all documents necessary, in a form to be
approved by the City Attorney, to close and abandon said alley and retain an easement
over said closed alley, currently and at such time in the future as the City transfers the
aforementioned property to a third party.
