RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, APPROVING THE ASSIGNMENT OF A WATER SALES
CONTRACT BETWEEN THE CITY OF WICHITA FALLS AND THE
DEAN DALE WATER SUPPLY CORPORATION TO THE DEAN DALE
SPECIAL UTILITY DISTRICT; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, on December 1, 1998, the City entered into a water sales contract
with the Dean Dale Water Supply Corporation; and,
WHEREAS, the Dean Dale Water Supply Corporation seeks to transfer its
assets, liabilities and contracts to a newly formed Dean Dale Special Utility District; and,
WHEREAS, Section 10.1 of the existing contract requires the City to consent to
any assignment of the existing contract.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City of Wichita Falls hereby consents to the assignment of the
December 1, 1998 contract befinreen the City of Wichita Falls and the Dean Dale Water
Supply Corporation to the Dean Dale Special Utility District. The City Manager is hereby
authorized to execute the necessary documents to evidence the City's consent.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
