Res 150-2007 10/16/2007 RESOLUTION NO. 150-2007 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, ESTABLISHING A 36 HOUR TIME LIMIT DURING THE CITY'S FISCAL YEAR THAT CITY PERSONNEL ARE REQUIRED TO MAKE COPIES OF PUBLIC INFORMATION, OR PRODUCE FOR INSPECTION OR DUPLICATION BY A REQUESTOR, WITHOUT RECOVERING ITS COSTS ATTRIBUTABLE TO THAT PERSONNEL TIME; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, House Bill 2564 was passed in the 80 Texas Legislative Session, WhICh a111211dS S@CtIOCI 552.275 Of the TEXAS LOCAL GOVERNMENT CODE; and, WHEREAS, this bill authorizes a governmental body to establish a reasonable limit on the amount of time its personnel are required to spend producing public information for inspection or duplication by a requestor, or providing copies of public information to a requestor, without recovering its costs attributable to that personnel time; and, WHEREAS, the minimum time limit authorized by this bill is not less than 36 hours for a requestor during the 12 month period that corresponds to the governmental body's fiscal year WHEREAS, the City Council finds and determines that establishing a 36 hour time limit as contemplated in this bill is in the best interests of the City of Wichita Falls. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. A thirty-six hour time limit within the City of Wichita Falls' fiscal year is hereby established that City personnel are required to make copies of public information, or produce for inspection or duplication by a requestor, without recovering its costs attributable to that personnel time. SECTION 2. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law.
