RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AUTHORIZING THE CITY MANAGER TO SIGN AN
INTERLOCAL AGREEMENT WITH WICHITA COUNTY TO PROVIDE
FOR THE PERFORMANCE OF MAGISTRATE SERVICES BY
MUNICIPAL JUDGES AND THE ESTABLISHMENT OF A CENTRALIZED
MAGISTRATE SUPPORT OFFICE BY WICHITA COUNTY; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the County Of Wichita and the City of Wichita Falls desire to enter
into an agreement to enhance the efficient administration of criminal justice in Wichita
County by providing for the performance of magistrate services by municipal judges and
the establishment of a central magistrate support office; and,
WHEREAS, such an agreement is authorized under Chapter 791, GOVERNMENT
CODE (Interlocal Cooperation Act).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The attached Interlocal Agreement is hereby approved.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.

INTERLOCAL COOPERATION AGREEMENT BETWEEN
THE CITY OF WICHITA FALLS AND WICHITA COUNTY, TEXAS

This Agreement, made and entered into this day of October, 2007, by
and between the County of Wichita ("County"), a county governmental entity located in
Wichita County, Texas, acting by and through its duly authorized County Judge, and the
City of Wichita Falls, Texas ("City"), a municipal corporation located in Wichita County,
Texas, acting by and through its duly authorized City Manager,
WITNESSETH :
WHEREAS, the County and the City desire to enter into an agreement to
enhance the efficient administration of criminal justice in Wichita County; and,
WHEREAS, such an agreement is authorized under Chapter 791, GOVERNMENT
CODE (Interlocal Cooperation Act).
NOW, THEREFORE, for and in consideration of the mutual covenants
hereinafter set forth, the City and the County agree as follows:
1. The City agrees to provide one weekday per week, excluding City
holidays, for use by Wichita Falls Municipal Judges to provide magistrate services, as
defined in the TEXAS CODE OF CRIMINAL PROCEDURE, for individuals charged with felonies
or Class A or B misdemeanors. Both parties acknowledge that Wichita Falls Municipal
Judges have discretion in determining the day, time, and manner of performance of
magistrate services.
2. The City and County agree that weekend magistrate services will continue to
be performed in accordance with the current interlocal agreement in effect.
3. The County agrees to establish, staff, and maintain, at its expense, a
centralized office to perform clerical, data entry, and all other support functions
necessary for magistrate activities.
4. This agreement shall remain in effect until terminated. Either party shall have
the right to terminate this Agreement, by giving the other party at least thirty (30) days
written advance notice of its intent to terminate the agreement.
