RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS,
TEXAS, TO ACCEPT THE 2007 LOOP 11 UTILITY RELOCATION PROJECT
CWF07-550-41, AND AUTHORIZE FINAL PAYMENT TO JIMMIE GARCIA'S
CONSTRUCTION, INC.; FINDING AND DETERMINING THAT THE MEETING
AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC
AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered a unit contract with Jimmie Garcia's
Construction, Inc. with the estimated total cost of $363,405.00; and
WHEREAS, the actual work was completed at a total cost of $362,805.00 of which
$342,264.75 has been previously paid to the Contractor; and
WHEREAS, with approval of the $2,400.00 in liquidated damages leaves a balance due
to the Contractor of $18,140.25.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. The 2007 Loop 11 Utility Relocation Project, CWF07-550-41 is hereby
accepted, with the assessed days of liquidated damages, and the City Manager is authorized to
make final payment to the contractor.
SECTION 2. It is hereby officially found and determined that the meeting at which this
resolution was passed was open to the public as required by law.
