RESOLUTION NO. _104-2011_
Resolution Authorizing The Sale Of Excess City Owned Property,
Consisting of 18.5 Acres And The Improvements Located At 4927 West
Highway 258, to Kyle Miller, in the amount of $80,000
WHEREAS, the City Council of the City of Wichita Falls, Texas, deems it
reasonable and in the best public interest to sell the property to include improvements
located at 4927 West Highway 258;
WHEREAS, the prospective buyer of the property has bid $80,000 at public auction
held on November 3, 2011 and deposited a check for 10% of the bid in the amount of
$8,000 with the Property Management Office; and
WHEREAS, the City Council finds that it is in the best public interest to sell the
property located at 4927 West Highway 258, thereby returning it to the tax rolls.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. In consideration of the receipt of $80,000, the sale of 18.5 acres and the

improvements located at 4927 West Highway 258, as depicted in the attached
MapWarranty Deed
and/or described in the attached , to Kyle Miller is approved.
2. The City Manager is authorized to execute all documents necessary to complete
the aforementioned sale.

BEGINNING at an iron rod found at the Northeast corner of said City tract, in the South
line of State Highway 258 and at the Northwest corner of a tract of land conveyed to G. L.
Poole by deed recorded in Volume 1185, Page 696, Wichita County Deed Records, said
rod bears N 89° 37’ 39” W a distance of 159.73 feet and S 00° 22’ 21” W a distance of
48.88 feet from the Northeast corner of said Block 49, said rod also being the Northeast
corner of this tract;
THENCE S 00° 19’ 52” W, with the East line of said City tract and the West line of said
Poole tract, a distance of 1997.50 feet to an iron rod set for the Southeast corner of this
tract;
THENCE N 88° 10’ 37” W a distance of 395.44 feet to a mag nail set for the Southwest
corner of this tract;
THENCE N 02° 07’ 40” W a distance of 620.03 feet to a fence corner for an angle corner
of this tract;
THENCE N 01° 47’ 51” E, with fence, a distance of 1205.00 feet to a fence corner for an
angle corner of this tract;
THENCE N 12° 51’ 35” E a distance of 167.39 feet to an iron rod set in the South line of
State Highway 258 for the Northwest corner of this tract;
THENCE S 89° 37’ 39” W, with the South line of State Highway 258, a distance of 354.76
feet to the PLACE of BEGINNING and containing 18.50 acres of land.
Reservations From and Exceptions to Conveyance and Warranty:
All validly existing easements and rights-of-way, whether of record or not, and all presently
recorded and validly existing restrictions, reservations, covenants, conditions, oil and gas leases,
mineral interests, and water interests outstanding in persons other than Grantor.
Grantor, for the consideration, receipt of which is acknowledged, and subject to the reservations
from and exceptions to conveyance and warranty, grants, sells and conveys to Grantee the
property, together with all and singular the rights and appurtenances thereto in any wise
belonging, to have and hold it to Grantee, Grantee’s heirs, executor, administrators, successors
or assigns forever. Grantor binds Grantor and Grantor’s heirs, executors, administrators and
successors to warrant and forever defend all and singular the property to Grantee and Grantee’s
heirs, executors, administrators, successors and assigns against every person whomsoever
lawfully claiming or to claim the same or any part thereof, except as to the reservations from and
exceptions to conveyance and warranty, when the claim is by, through or under, Grantor, but not
otherwise.
