RESOLUTION NO. 198-2007
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS,
TEXAS, TO AUTHORIZE AN AMENDMENT TO THE INTERLOCAL
AGREEMENT WITH CLAY COUNTY REGARDING SUBDIVISION REVIEW IN
THE CITY'S EXTRA TERRITORIAL JURISDICTION; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS
PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls provides subdivision review within it's Extra
Territorial Jurisdiction (ETJ) inside of Clay County as established by an Interlocal Agreement
dated January 5, 2004; and
WHEREAS, Clay County wishes to amend the Agreement regarding On Site Sewer
Facility (OSSF) regulations;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City Manager is hereby authorized to execute an Amendment
substantially in the form of the attached, regarding OSSF regulations and exempting City
owned properties.
SECTION 2. It is hereby officially found and determined that the meeting at which this
resolution was passed was open to the public as required by law.

Re: Amendment to the City of Wichita Falls/Clay County Interlocal Agreement Regarding
Subdivision Authority, executed by Clay County on December 22, 2003 and by City of
Wichita Falls on January 5, 2004.
This letter sets forth our agreement in which both the County and the City have agreed to amend
the above referenced Interlocal Agreement by adding an additional paragraph.
That additional paragraph shall be as follows:
"2.10 Unless municipal sewer service is provided to the subdivision, the City will not
approve any subdivision plat located in the County, unless said subdivision plat meets the
On-Site Sewer Facility(OSSF) regulations of the County. Properties owned by the City of
Wichita Falls shall be exempted from this requirement. The County shall provide the
City with the County's current OSSF regulations and any subsequent regulations or
amendments thereto."
If the City agrees to said amendments, please sign below. The County has executed this letter
evidencing its agreement to said amendment. All other terms of the above referenced Interlocal
Agreement are to remain in full f• e and effect.
