ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, WAIVING THE FIVE PERCENT PENALTY AS
ESTABLISHED BY SECTION 98-96 OF THE CODE OF ORDINANCES
FOR THE HOLIDAY INN FOR FAILURE TO PAY HOTEL/MOTEL TAXES
DUE TO THE CITY FOR A PERIOD OF SIXTY DAYS; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, City Ordinance requires the City to assess a five percent penalty for
late payment of Hotel/Motel Occupancy Taxes; and
WHEREAS, the Holiday Inn has requested that the City waive this late payment
penalty for their July and August 2007 payments as a result of the recent flood disaster;
and
WHEREAS, the Holiday Inn has a long history of timely payments of Hotel/Motel
Taxes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City hereby waives the five percent penalty as established by
Section 98-96 of the Code of Ordinances for the Holiday Inn for failure to pay its
Hotel/Motel Taxes for a period of sixty days.
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
