ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AMENDING ORDINANCE #31-2005, PLACING
DAVILLA TRANSPORTATION, INC. DBA ALL AMERICAN
TRANSPORTATION ON SIX MONTHS PROBATION, REDUCING THE
NUMBER OF VEHICLES AUTHORIZED UNDER THE FRANCHISE AND
PROVIDING NOTICE OF FRANCHISE CANCELLATION WITH
FURTHER VIOLATIONS OF SECTION 110 "VEHICLES FOR HIRE";
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, Ordinance #31-2005 can be amended to place taxi cab franchise
holders on probation; and
WHEREAS, Section 110-62(a) allows the City Council to reduce the number of
authorized vehicles assigned to each franchise; and
WHEREAS, All-American Taxi has licensed 7 vehicles, while being authorized
17; and
WHEREAS, The City of Wichita Falls regulates the taxi cab business and the
franchisees are required to serve the interest and public needs of the citizens of Wichita
Falls; and
WHEREAS, The City of Wichita Falls regulates the taxi cab business and the
franchisees are subject to revocation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Ordinance #31-2005 is hereby amended to place Davilla
Transportation, Inc. DBA All American Transportation on six months probation ending
August 16, 2007.
SECTION 2. In accordance with Section 110-62(a), All American's Taxi's
franchise is hereby licensed to operate 7 vehicles.
SECTION 3. The current operations of the franchise are not serving the interest
and public needs of the citizens of Wichita Falls.

SECTION 4. During and after the term of probation specified in Section 1,
continued non-compliance with Section 110 will result in revocation of franchise permits
to operate a taxi-cab service in Wichita Falls.
SECTION 5. It is hereby officially found and determined that the meeting at
which this Ordinance was passed was open to the public as required by law.
