ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AMENDING SECTION 106-128 OF THE CODE OF
ORDINANCES REGARDING CREDIT CARD PAYMENTS FOR UTILITY
BILLS; FINDING AND DETERMINING THAT THE MEETING AT WHICH
THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City currently accepts Visa and MasterCard payments from
residential customers only for the payment of utility bills; and
WHEREAS, the City currently charges utility customers a convenience fee in the
amount of 5% of the credit card transaction up to an amount not to exceed $2.00 per
transaction; and
WHEREAS, the City currently charges this convenience fee to customers that
pay in person at the Utility Collection Office, and
WHEREAS, the City desires to begin accepting credit card payments for utility
bills through an on-line process, and
WHEREAS, doing so will not allow for payments to be limited to residential
customers or for convenience fees to be based on a percentage of the transaction; and
WHEREAS, current Visa and MasterCard rules prohibit collection of a
convenience fee to customers who pay by credit card in person.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 106-28 of the Code of Ordinances is hereby amended in it's
entirety to read as follows:
"Sec. 106-128. Credit card payments; convenience fees.
(a) The utility collection division may accept credit cards from Visa and MasterCard for
payments collected by the utility collection division..
(b) A convenience fee of $3.00 per transaction shall be assessed to the customer
paying by credit card over the telephone or through the City's website to reimburse the
City for reasonable expenses incurred to process the transaction. No convenience fee
will be assessed to customers paying by credit card in person at the Utility Collection
Office.
SECTION 2. It is hereby officially found and determined that the meeting at which this
ordinance was passed was open to the public as required by law.
