ORDINANCE CLOSING, ABANDONING, AND VACATING REED DRIVE
WHICH ABUTS 3100 NORTHEAST DRIVE TO THE SOUTH AND CUTS
THROUGH 3100 NORTHEAST DRIVE TO THE NORTHEAST AS REQUESTED
BY THE PROPERTY OWNERS WHO RESIDE AT 3100 NORTHEAST DRIVE,
WICHITA FALLS, TEXAS, AS INDICATED ON THE ATTACHED PLAT MAP
ENTITLED ATTACHMENT "A" AND ATTACHMENT "B". TOTAL
ABANDONMENT IS EQUAL TO APPROXIMATELY 24,914 SQUARE FEET.
REED STREET IS AN UNPAVED PAPER STREET; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS
PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, Randy Lon Cannedy of 3100 Northeast Drive, Wichita Falls, Texas
has requested the City close, abandon, and vacate Reed Drive; and
WHEREAS, all affected City departments and affected utility companies have
been contacted and have approved or conditionally approved this closure with the filing
of an approved re-plat; and
WHEREAS, the City Council of the City of Wichita Falls, Texas, deems it
reasonable and in the publics best interest to close, abandon, and vacate this portion of
Reed Drive hereinafter described, subject to application being made and a final re-plat
submitted to the City within six (6) months of the date of this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The street called Reed Drive, is hereby closed, abandoned, and
vacated as indicated on the final plat Attachment "A" and Attachment "B".
SECTION 2. In consideration of the receipt of Seven Thousand Seven Hundred
Dollars ($7,700) for the value of the street to be closed and One Hundred Fifty Dollars
($150.00) for the cost of the appraisal, this ordinance shall authorize the City Manager
to execute a quitclaim deed for the City's interest in the property. The deed shall be
executed conditioned upon the property owner's filing an approved re-plat of the
property in the records of the Wichita County Clerk. This filing shall occur within six (6)
months of the date of approval of this ordinance.
SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
