ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AMENDING ORDINANCE NO. 55-2006 TO GRANT
ADDITIONAL TIME FOR THE OWNER OF THE PROPERTY AT
1658 ARDATH STREET TO REHABILITATE THE STRUCTURE;
DECLARING AN EMERGENCY; FINDING AND DETERMINING
THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED
WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the property at 1658 Ardath Street was included in a list of
properties for consideration as hazardous structures by the City Council at their meeting
on July 18, 2006; and,
WHEREAS, Mr. Phillips, the then-owner of the property, appeared at the
meeting and requested time to rehabilitate the structure; and,
WHEREAS, the City Council granted Mr. Phillips ninety (90) days to obtain a
restoration permit, show substantial progress, clean up and secure the property; and,
WHEREAS, at its meeting of December 19, 2006, the City Council passed
Ordinance No. 98-2006, granting Mr. Phillips thirty (30) days to have a licensed
contractor obtain a Restoration Building Permit; requiring that substantial progress be
made within sixty (60) days after January 18, 2007; and further requiring that a
Certificate of Occupancy be obtained by March 19, 2007; and,
WHEREAS, failure to meet these timeframe requirements would result in the
demolition of the structure without further notification; and,
WHEREAS, Mr. Phillips has subsequently sold this property to Stacy Gostnell,
who obtained a Restoration Building Permit through a contractor; and,
WHEREAS, despite a level of progress being made, the property owner has
failed to obtain a Certificate of Occupancy by the March 19, 2007 deadline; and,
WHEREAS, it is the desire of the City Council to grant the property owner
additional time to rehabilitate the structure.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . Additional time in the amount of 120 days to end at the
end of the business day on August 15 , 2007, is granted to
the property owner of 1658 Ardath Street to have accomplished substantial progress on
the rehabilitation of this structure; and a Certificate of Occupancy shall be obtained by
the end of the business day on Auqust 15 , 2007.
Failure to complete these timeframe requirements will result in the demolition of the
structure, without further notification. Upon issuance of a Certificate of Occupancy, the
demolition order shall become void.
SECTION 2. Due to the fact that the subject matter of this ordinance affects the
public health, safety and welfare of the citizens of the City of Wichita Falls, this
ordinance is declared to be an emergency measure and shall become effective
immediately upon its passage.
SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
