Min 07/18/2017 CITY COUNCIL MINUTES July 18, 2017 Page 1 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building July 18, 2017 Item 1 - Call to Order The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o’clock a.m., with the following members present. Stephen L. Santellana - Mayor Michael Smith - Councilors DeAndra Chenault - Jesse Brown - Romeo Montez - Eric West - Brian Hooker - Darron Leiker - City Manager Kinley Hegglund - City Attorney Tracy Norr - City Clerk - - - - - - - - Mayor Santellana called the meeting to order at 8:30 a.m. - - - - - - - - Item 2 – Invocation and Pledge of Allegiance Pastor Tommy Free, Lamar Baptist Church, gave the invocation. Mayor Santellana led the Pledge of Allegiance. - - - - - - - - Item 3 – 5a - Consent Items 8:33:24 AM City Manager Darron Leiker gave a briefing on the items listed under the Consent Agenda. Mo ved by Councilor Hooker that the consent items be approved. Motion seconded by Councilor Brown and carried by the following vote: Ayes: Mayor Santellana, Councilors Brown, Chenault, Hooker, West, Montez, and Smith. Nays: None CITY COUNCIL MINUTES July 18, 2017 Page 2 Item 3 - Approval of Minutes of the July 5, 2017 Regular Meeting of the Mayor and City Council Item 4 – Resolution #94-2017 Resolution #94-2017 Resolution authorizing the City Manager to award bid and contract for the 2017 Alley Rehabilitation Project to Freeman Paving, L.L.C. in the amount of $285,238.00 Item 5 - Receive Minutes Minutes of the following boards and commissions were received: (a) Landmark Commission, April 25, 2017 - - - - - - Item 6 – Public Hearing to Receive Citizen Comments Concerning the Proposed 2017 Annual Action Plan to Allocate FY 2017 Community Development Block Grant (CDBG) Funds in the Amount of $1,122,227 and FY 2016 HOME Investment Partnership Program (HOME) Funds in the Amount of $274,508 Mayor Santellana opened the public hearing at 8:34:49 AM Michael Uriniak said a public hearing had been held regarding the proposed funding and activities. He said the requests were for more than the funds available for al location. He discussed eligibility requirements for the public agencies to receive funding. He listed the proposed allocation as: Child Care, Inc., $107,834; Senior Citizens Service of North Texas – Meals on Wheels, $43,500; Christmas in Action - $52,115.60; Phased In, $27,000; CDBG for City Departments, $891,777.40; First Time Homebuyer Program, $183,881; Affordable Housing Program, $22,000; CHDO Set-Aside, $41,167.20; HOME Administration, $27,450.80. Councilor Smith asked about using funds for demolition of a commercial building. He was told there are requirements which limit this. Councilor Brown said the Outside Agency Committee is comfortable with the allocations as presented. Cassie Ahern, director of Christmas in Action , talked about the work being done by Christmas in Action. Carrie Gowens, Child Care Inc., thanked the council for their support over the years. Pam Hughes, 1000 Burnett, expressed appreciation for the support of the Kitchen/Meals on Wheels program. Mayor Santellana thanked the committee for the allocations and thanked those who spoke. There were no other comments and the public hearing was closed at 8:48:37 AM - - - - - - CITY COUNCIL MINUTES July 18, 2017 Page 3 Item 7a – Ordinance #24-2017 8:48:47 AM Ordinance No. 24-2017 Ordinance Amending Ordinance 86-31 to Remove from the Library Board Membership the Ex Officio Positions for the President of the Friends of the Library and the City Manager Moved by Councilor Chenault to approve Ordinance No. 24-2017. Motion seconded by Councilor Hooker. Dr. Alan Martin, president of the Friends of the Library, said they have not severed their relationship or support of the library. He discussed some of the activities of the organization. He said there are 46 active volunteers. He said it is inappropriate to vote on this ordinance right now because there is not a library director. Discussion was held about the need for these positions on the Library Advisory Board and the fact that the meetings are open to the public to accept input. Councilor Brown said he would be in favor of amending the ordinance to allow this ex- officio member to stay on the board. Counc ilor Smith agreed. Mayor Santellana said he does not have any issues with leaving this position on the board. Mo ved by Councilor Brown to amend the ordinance to delete the removal of the Friends of the Library president as an Ex Officio Position on the Library Advisory Board Amendment seconded by Councilor Smith. Motion carried by the following vote: Ayes: Mayor Santellana, Councilors Brown, Chenault, Hooker, West, and Smith Nays: Councilor Montez. Motion as amended carried by the following vote: Ayes: Mayor Santellana, Councilors Brown, Chenault, Hooker, West, Smith, and Montez Nays: none - - - - - - ***The following item was heard out of order.*** Item 8c – Resolution #97-2017 9:07:27 AM Resolution #97-2017 Resolution Granting a Petition for Annexation for Approximately 12.77 Acres of Land (Trophy Park, Section 4 Residential Subdivision) Out of Blocks 12 & 13, League 2, CITY COUNCIL MINUTES July 18, 2017 Page 4 Denton County School Land, Abstract No. 57, Located at 5018 and 5030 Gregg Road under Authority of Texas Local Government Code Section 43.028 – Authority of Municipalities to Annex Sparsely Occupied Area on Petition of Area Landowners Moved by Councilor Brown that Resolution No. 97-2017 be passed. Motion seconded by Councilor Hooker and carried by the following vote: Ayes: Mayor Santellana, Councilors Brown, Chenault, Hooker, West, Smith, and Montez Nays: None - - - - - - Item 7b– Ordinance #25-2017 9:24:11 AM Ordinance No. 25-2017 Ordinance Annexing 12.77 Acres of Land Out of Blocks 12 & 13, League 2, Denton County School Land, Abstract No. 57, Located at 5018 and 5030 Gregg Road at the Request of the Property Owner; Accepting the Trophy Park Subdivision Servicing Plan for Said Tract under Authority of Texas Local Government Code Section 43.028 – Authority of Municipalities to Annex Sparsely Occupied Area on Petition of Area Landowners Moved by Councilor Hooker to approve Ordinance #25-2017. Motion seconded by Councilor Brown and carried by the following vote: Ayes: Mayor Santellana, Councilors Brown, Chenault, Hooker, West, Smith, and Montez Nays: None - - - - - - Item 7c – Ordinance #26-2017 9:26:19 AM Ordinance No. 26-2017 Ordinance Authorizing the Issuance of the City’s Combination Tax and Limited Surplus Revenue Certificates of Obligation, Series 2017 Moved by Councilor Hooker to table adoption of the ordinance authorizing the issuance of the City's Combination Tax and Limited Surplus Revenue Certificates of Obligation, Series 2017 to the City Council meeting scheduled to begin at 8:30 A.M., September 5, 2017, at th e City Hall, 1300 7th Street, Wichita Falls, Texas. Motion seconded by Councilor Brown and carried by the following vote: Ayes: Mayor Santellana, Councilors Brown, Chenault, Hooker, West, Smith, and Montez Nays: None - - - - - - Item 8b – Resolution #96-2017 9:32:10 AM Resolution #96-2017 Resolution Amending Resolution 53-2013 that Establishes the Ad Hoc Lake Wichita Revitalization Committee Membership to Change Place 3 from Chairman of the Park Board to At-Large City Resident Moved by Councilor Brown that Resolution No. 96-2017 be passed. Motion seconded by Councilor Chenault and carried by the following vote: Ayes: Mayor Santellana, Councilors Brown, Chenault, Hooker, West, Smith, and Montez Nays: None - - - - - - Item 9 – Items of Concern to Members of the City Council 9:33:58 AM Members of the City Council presented the following matters: Councilor Brown thanked staff. Councilor Chenault thanked those in attendance. - - - - - - - CITY COUNCIL MINUTES July 18, 2017 Page 6 Item 10 – Comments from the Public to Members of the City Council 9:34 AM Paula Gay Saenz, 715 Powell Lane, said she has a letter she sent to Judge Little and two pastors. The letter explains the problems she has gone through with her common law marriage to Victor Saenz. She said women on disability need better representation and stiffer laws on common law marriage. She said during the initial separation from her husband, her neighbors intervened and it has been a continuing problem with them calling police. The officers get upset with her. She said her neighbor has been sexually harassing her. Mayor Santellana said the city cannot address her first issue, and she needs to file a complaint with the police department for the harassment issue.
