Resolution authorizing the purchase of three (3) 35-foot low floor
diesel buses off the Capital Metro Transportation Authority Contract
#128745 to Gillig LLC in the amount of $1,265,115
WHEREAS, Federal Transit Administration allows for piggybacking purchases as
indicated in Section 6.3.3 of its Best Practices Procurement Manual; and,
WHEREAS, Capital Metro Transportation Authority had solicited and contracted
for buses through Gillig Corporation; and,
WHEREAS, Capital Metro Transportation Authority had three (3) 35-foot, low floor
diesel buses remaining on its contract with Gillig Corporation; and,
WHEREAS, the City of Wichita Falls has requested and received authorization
from Capital Metro Transportation Authority to piggyback on the purchase of three 35-
foot, low floor diesel buses that remain on its contract with Gillig Corporation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
City staff is authorized to execute all documents necessary to purchase three (3)
35-foot, low floor, diesel buses with Gillig LLC through Capital Metro Transportation
Authority contract #128745 in the amount of $1,265,115.
PASSED AND APPROVED this the 20t" day of June, 2017.

Dear Mr. Burkett
This letter acknowledges and approves your letter request of April 25, 2017, to acquire three (3)
Gillig 35 foot low floor diesel buses utilizing the terms and prices established tuider Capital
Metro's Contract 135903 with Gillig, LLC.
Other than using Capital Metro's RFP and contract docurnents,mid the pricing and terms, there
will be no other involvernent by Capital Metropolitan Transportation Authority.
WFTS will be responsible for enterhig unto separate piggybacking contract with Gillig LLC, is
responsible for paying Gillig directly for the vehicles, mid will be responsible for the Pre- and
Post -Award Buy America Audit.
A modification to the Gillig contract will be copied to you that includes this assignment.
Please let me know of the documents you require frorn Contract 135903.

RE: Gillig Bus Purchase Option
Wichita Falls Transit System (WFTS) requests your approval to permit WFTS to acquire three (3)
35 foot low floor diesel buses using your options as listed in the CMTA Contract.
The purpose of this request and agreement is to allow WFTS to purchase three (3j Muses,
utilizing the contract and terms and the }prices already established. WFTS will pay the Gillig
Corporation directly. tether than using the contract pricing and terns, there will be no involvement
by Capital Metro Transit Authority:
Your approval of extending the assignability of this contract to WFTS would be greatly
appreciated. if you and your agency are willing to allow WFTS to use your options as listen in the
CMTA contract RFP, to purchase three (3) 35 foot low floor diesel buses from the Giilig
Corporation please sign and date your concurrence below, or respond with a confirmation letter.

This price is valid for thirty days and is FOB Wichita Falls TX. Prices exclude any taxes
and license fees. The production of your buses can be scheduled within 14 months
from date of P.O. To maintain this production schedule we will require a firm purchase
