ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AUTHORIZING WAIVER OF BUILDING PERMIT FEES
FOR REPAIR PROJECTS CERTIFIED AS RESULTING FROM THE 2007
WICHITA RIVER FLOOD OR OTHER INCLUDED EVENTS THAT ARE
PART OF A FEDERALLY DESIGNATED DISASTER AND DECLARING
AN EMERGENCY; FINDING AND DETERMINING THAT THE MEETING
AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, local citizens have suffered flood damage from the 2007 Wichita
River Flood and related problems that are part of a federally declared disaster; and
WHEREAS, the City Council wishes to assist their recovery as they are able; and
WHEREAS, the City Council is prepared to waive certain building permit fees for
affected property owners needing to repair their flood damaged structures.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Applicable electrical, mechanical, plumbing, and building permit
fees shall be waived for repair activities resulting from documented damage from the
2007 Wichita River Flood or other related events that are a part of a federally declared
disaster. Such waiver shall be available for a one year period from the date of the
effect of this Ordinance.
SECTION 2. Such waiver shall also be retroactive for repair permits that were
obtained for this purpose after July 1, 2007.
SECTION 3. Due to the fact that the subject matter of this Ordinance affects the
public health, safety, and general welfare of the citizens of Wichita Falls, this Ordinance
is declared to be an emergency measure and shall become effective immediately on its
passage.
SECTION 4. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
