Ord 092-2007 10/2/2007 _ .♦ ORDINANCE NO. 92-2007 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING APPENDIX B ZONING, AT SECTIONS 3080, 3140, 3210, 3290, 3365 AND 3410, REGARDING THE MAXIMUM HEIGHTS ALLOWED FOR SCHOOL AND RELIGIOUS ASSEMBLY USES; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the Planning and Zoning Commission considered this zoning amendment regarding the maximum height requirement for School and Religious Assembly uses, and voted to recommend approval of said amendment; and WHEREAS, the City Council of the City of Wichita Falls, Texas, concurs with this recommendation and determines that the herein described changes are in the public interest. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1 The City of Wichita Falls Code of Ordinances, Appendix B Zoning, is hereby amended at Section 3080 to read as follows: "3080 Development Regulations Each site in the SF-1 District shall be subject to the following site regulations except zero lot line single family dwellings and limited multifamily residential developments: I. Lot area: 8,500 sq. ft., minimum for single family dwelling; 5,000 sq. ft. minimum for other uses 2. Lot width: 60 ft., minimum for single family dwelling; 50 ft. minimum for other uses. 3. Residential density: 1 primary dwelling unit per lot, maximum. 4. Height: 35 ft., maximum. For School and Religious Assembly uses, the maximum height shall be 45 feet. 5. Building coverage: 50% of lot area, maximum Note: See Section 4600 for buffering requirements." ✓ , �_ SECTION 2. The City of Wichita Falls Code of Ordinances, Appendix B Zoning, is hereby amended at Section 3140 to read as follows: "3140 Development Regulations Each site in an SF-2 District shall be subject to the following site regulations except for zero lot line single family residential use and limited multifamily residential developments: 1. Lot area: 5,000 sq. ft., minimum 2. Lot width: 50 ft., minimum 3. Residential density: No more than one (1) primary dwelling unit per lot, except for duplex residential. 4. Height: 35 ft., maximum. For School and Religious Assembly uses, the maximum height shall be 45 feet. 5. Building coverage: 50% of lot area, maximum. Note: See Section 4600 for buffering requirements." SECTION 3. The City of Wichita Falls Code of Ordinances, Appendix B Zoning, is hereby amended at Section 3210 to read as follows: "3210 Development Regulations Each site in an MFR District shall be subject to the following site regulations except for zero lot line single family residential and townhouses: 1. Lot area: 5,000 sq. ft., minimum 2. Lot width: 50 ft., minimum 3. Height: 40 ft., maximum, except for multi-family dwellings exceeding 25 units per acre. For School and Religious Assembly uses, the maximum height shall be 45 feet. 4. Building Coverage: 50% of lot area, maximum. 5. Open Space: 20% of Lot Area, minimum, for multi-family dwellings containing 25 units or more. f r d. NOTE: See Section 4600 for buffering requirements." SECTION 4. The City of Wichita Falls Code of Ordinances, Appendix B Zoning, is hereby amended at Section 3290 to read as follows: "3290 Development Regulations Each site in the RMU district shall be subject to the following development regulations except for zero lot line residential, townhouses, and mobile home parks and subdivisions. I. Lot area: 5,000 sq. ft., minimum 2. Lot width: 50 ft., minimum 3. Height: 35 ft., maximum. For School and Religious Assembly uses, the maximum height shall be 45 feet. 4. Building Coverage: 55% of lot area, maximum, except 50% of the lot area, maximum, for single-family and duplex dwellings. 5. Open Space: 20% of lot area, minimum, for multi-family dwellings containing 25 units or more. Note: See Section 4600 for buffering requirements." SECTION 5. The City of Wichita Falls Code of Ordinances, Appendix B Zoning, is hereby amended at Section 3365 to read as follows: "3365 Development Regulations Each site in an LO District shall be subject to the following development regulations, except for zero lot line dwellings: 1. Lot area: 5,000 square feet minimum 2. Lot width: 50 ft. minimum 3. Height: A. Residential uses, 35 feet, maximum B. For Religious Assembly uses, the maximum height shall be 45 feet. All other nonresidential uses: 1 story maximum not exceeding 25 ft. 4. Building Coverage: 50% of lot area, maximum Note: See Section 4600 for buffering requirements." SECTION 6. The City of Wichita Falls Code of Ordinances, Appendix B Zoning, is hereby amended at Section 3410 to read as follows: "3410 Development Regulations Each site in an LC District shall be subject to the following development regulations, except for zero lot line residential and townhouses. I. Lot area: 5,000 sq. ft., minimum 2. Lot width: 50 ft., minimum 3. Height: 35 ft. maximum. For School and Religious Assembly uses, the maximum height shall be 45 feet. 4. Building coverage: 55% of lot area, maximum, except 50% of the lot area, maximum, for single-family and duplex dwellings. 5. Open Space: 20% of lot area, minimum, for multi-family dwellings use containing 25 units or more. Note: See Section 4600 for buffering requirements." SECTION 7. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
