Ord 17-2017 6/6/2017PAGE 1 OF 2 PAGES AGENDA ITEM NO. 7.A Ordinance No. _17-2017_ Ordinance amending the Code of Ordinances of the City of Wichita Falls, Texas Chapter 94, Streets, Sidewalks, and Other Public Places, Article I, In General, by the Addition of Section 94 -18, Street Medians; providing a repealer clause; providing for inclusion in the Code; providing for severability WHEREAS, the City Council finds that it is reasonable to control the surface material and placement o f street medians that the City will be responsible to maintain and; WHEREAS, the City has limited resources to maintain street medians. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. The Code of Ordinances of the City of Wichita Falls is amended at Chapter 94, Streets, Sidewalks, and Other Public Places, Article I., In General, by the Addition of Section 94-18, Street Medians, which section shall hereafter read as follows: “Sec. 94-18. – Street Medians (a) Definitions. (1) Medians: a strip of land, whether raised or flush, between the lanes of opposing traffic on a divided street. (b) Generally. (1) Raised medians shall not be allowed except when required by the thoroughfare plan or other gove rnment agency. (2) Any required raised median shall be made of solid material that requires no routine maintenance nor designed to contain vegetation including, but not limited to grass, shubs, or trees . (3) Flush medians shall have the surrounding pave ment structure extended across the entire median. The flush median shall be delineated with approved pavement markings. (4) City Manager or designee may approve a varience to the items above where circumstances allow.” 2. All ordinances or parts of o rdinances in conflict herewith are hereby repealed. It is the intention of the City Council of the City of Wichita Falls, Texas, that the provisions of this ordinance shall become a part of the Code of Ordinances of the City of Wichita Falls, Texas, an d that sections of this ordinance may be renumbered or relettered to accomplish such intention. 4. Should any word, phrase, paragraph, section or portion of this ordinance or the Code of Ordinances, as amended hereby, be held to be void or unconstitutional , the same shall not affect the validity of the remaining portions of said ordinance or the Code of Ordinances, as amended hereby, which shall remain in full force and effect.
