Ord 098-2007 11/6/2007 .� ORDINANCE NO. 98-2007 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING THE CODE OF ORDINANCES AT CHAPTER 2, ADMINISTRATION, ARTICLE III, BOARDS, COMMITTEES AND COMMISSIONS, BY THE ADDITION OF DIVISION 11, EMERGENCY MEDICAL SERVICES ADVISORY BOARD; PROVIDING FOR THE CREATION OF THE BOARD; PROVIDING FOR INCLUSION IN THE CODE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, Wichita County and the cities of Wichita Falls, Burkburnett and lowa Park are currently parties to an agreement with American Medical Response Ambulance Service, Inc.; and WHEREAS, the current agreement expires in February, 2008; and WHEREAS, it is the desire of the entities covered under this or any subsequent agreement with an emergency medical services provider that its citizens are provided the best available emergency medical assistance; and, WHEREAS, the City Council of the City of Wichita Falls deems it to be in the best interests of the City and its citizens to create an Emergency Medical Services Advisory Board to provide advice and assistance regarding the operation of emergency medical services. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The Wichita Falls Code of Ordinances is hereby amended at Chapter 2, Administration, Article III, Boards, Committees and Commissions, by the addition of Division 11, Emergency Medical Services Advisory Board, which Division shall read as follows: "DIVISION 11. EMERGENCY MEDICAL SERVICES ADVISORY BOARD Sec. 2-390. Creation. There is hereby created an Emergency Medical Services Advisory Board. Sec. 2-391. Representation. The Emergency Medical Services Advisory Board shall be composed of nine members, more particularly identified as follows: ., � '� 1. City Manager of the City of Wichita Falls, or his designee 2. Fire Chief of the City of Wichita Falls, or his designee 3. City Manager of the City of Burkburnett, or his designee 4. City Administrator of the City of lowa Park, or his designee 5. Wichita County Judge, or his designee 6. One appointment by the Mayor and City Council of the City of Wichita Falls who is licensed to practice medicine in the State of Texas 7. One appointment by the Mayor and City Council of the City of Wichita Falls with no specific qualifications 8. One appointment by the Wichita County Commissioners with no specific qualifications 9. One appointment to be shared by the governing bodies of the cities of Burkburnett and lowa Park with no specific qualifications. Sec. 2-392. Term of office; meetings. (a) A chairperson for the Board shall be selected by the appointed members from among the group. The term of office as chairperson will expire at the end of the calendar year annually, and the chairperson shall be eligible for reelection. (b) The Board shall meet not less than annually, and minutes from each meeting with observations and recommendations shall be submitted to the City Council at a regularly scheduled Council meeting. (c) The members of the Board shall be residents of the entities by whom they were appointed. The appointed members shall serve for terms of finro years; however, the initial terms shall be staggered so that the appointment made by the Wichita County Commissioners and the appointment shared by Burkburnett and lowa Park [(8) and (9) in Section 2-391 above] shall be initially appointed for a term ending December 31, 2008, and the appointments by Wichita Falls [(6) and (7) in Section 2-391 above] shall initially be made for terms ending December 31, 2009. Thereafter, all members' terms shall end on December 31. Each member shall continue to serve until his successor is appointed. A member may be removed for any reason by the entity that made the appointment. Sec.2-393. Duties. (a) All members of the Emergency Medical Services Advisory Board shall have the same powers as any other member, including the right to vote, on all matters before the Board. (b) No person shall serve on the Board if such person is an officer, director, employee, or is otherwise affiliated with, directly or indirectly, any ambulance operator whose activities are regulated by Chapter 42 of the Wichita Falls Code of Ordinances. � , ,' (c) The Emergency Medical Services Advisory Board shall meet at least once annually to monitor the following sections of the joint Ambulance Services Contract between the cities of Wichita Falls, Wichita County, Burkburnett and lowa Park: i. Personnel ii. Vehicles iii. Financiallnformation iv. Service Level (d) In addition to the minimum annual meeting, the Board shall meet on an as-needed basis to review any citizen complaint received by any of the entities related to the provision of emergency medical services under the Ambulance Services Contract. Any complaint must be written, signed and sent to the attention of any of the governing bodies of the entities to convene a meeting of the Board. It shall be the responsibility of recipient to direct the complaint to the Emergency Medical Services Advisory Board. (e) The Emergency Medical Services Advisory Board's authority to review the service under this article shall in no way affect the independent contractor relationship between the entities and any contractor under this article, and the review thereof is to make inquiry as to whether or not adequate emergency medical services are being provided to the citizens of the city, but not for the purposes of controlling the duties or functions of the operation or specific means or manner of supplying such service by the contractor." SECTION 2. It is the intention of the City Council of the City of Wichita Falls, Texas, that the provisions of this ordinance shall become a part of the Code of Ordinances of the City of Wichita Falls, Texas, and that sections of this ordinance may be renumbered or relettered to accomplish such intention. SECTION 3. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
