Min 02/20/2007 r 34 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building February 20, 2007 Item 1 The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o'clock a.m., with the following members present: Lanham Lyne - Mayor Ray Gonzalez - Mayor Pro Tern Jim Ginnings - Councilors Linda Ammons - Dorothy Roberts-Burns - Rick Hatcher - Charles Elmore - Darron Leiker - City Manager Bill Sullivan - City Attorney Lydia Ozuna - City Clerk Mayor called the meeting to order. Item 2a Pastor David Barnes, New Life Church, gave the invocation. Item 2b Councilor Gonzalez led in the Pledge of Allegiance. Item 3 Mayor introduced Mr. Roby Christi and his wife Mrs. Renee Christi. County Judge Woody Gossom informed that the Community Builder Award is the highest award that can be presented to a non-Mason, and it recognizes individuals who have distinguished themselves through their service to the community, the local, state or national government, to their church or synagogue, or to humanity. The award being presented by Faith Lodge No. 1158 recognizes Mr. Roby Christi is such an individual who has given remarkable service to this community. His efforts along with others in the Wichita Falls Bicycling Club planned and executed the first Hotter than Hell Hundred bicycle race with some 1100 riders which grew to over 11,000 riders in six years. Faith Lodge Master Gary Pearce presented Mr. Roby Christi with the Community Builders Award from the Grand Lodge of Texas. Mr. Pearce expressed appreciation to Mr. Christi for his untiring and dedicated service to our community. Mr. Christi expressed appreciation and stated that this was a very important award being presented in this room from the Masons because they do so many very important acts of kindness and service. This award is very important to Renee and me. Mayor Lyne read and presented a proclamation to Mr. Roby Christi stating that every city should be lucky enough to have a Roby Christie; someone with the ability to take a dream and make it come alive, someone who cherishes the goodness of his community and someone who makes others feel just as proud as he does about his hometown. He mentioned that Roby Christie has become Wichita Falls' unparalleled champion of public relations by enticing thousands and thousands of people to visit our City year after year. Mayor Lyne proclaimed February 20, 2007 as "Roby Christie Day in Wichita Falls", and urged all citizens to thank Roby for his vision, intense 35 Item 3 continued dedication and sincere desire to see Wichita Falls grow and prosper. Mr. and Mrs. Christi accepted the proclamation to a standing ovation from the City Council and the audience. Item 4 Adam Sharp, 2308 Farrington, spoke in support and protection of the Patriot Act. Councilor Ginnings stated that Mary Ann Tittsworth is a long time resident of Wichita Falls and supervisor at the Post Office. He has known her for a long time, and he would like to commend to the Council the matter which she will address. Mary Ann Tittsworth, 2810 Barrywood, expressed appreciation to the Council for the investment they make in our community. I have on occasion spoken to a council member about a matter but very rarely; usually I speak more about you to the Heavenly Father. He is the only source of wisdom. For several years I have been a part of a group that prays about City issues and for City Council, and city government at all levels. She presented Council with a gift of a 40- day Guide to Prayer. Mayor thanked Mrs. Tittsworth and stated that we can all use more prayer. Item 5 The Minutes were approved as distributed. Items 6a-6b City Manager gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Roberts-Burns that the Consent Agenda be approved. Motion seconded by Councilor Elmore and carried by the following vote. Ayes: Mayor Lyne, Councilors Ginnings, Ammons, Roberts-Burns, Hatcher, Gonzalez, and Elmore Nays: None Minutes of the following board and commission meetings were received (a) 4B Sales Tax Corporation — November 3, 2006 (b) Traffic Safety Commission —January 3, 2007 Item 7a A public hearing was held to consider a request to increase the number of Special Service Permits to Moonlight Limousine Service. Mayor declared the public hearing open. Mr. John Burrus provided information on his report regarding current limousine service in Wichita Falls and information on Dave Zentgraf's request. He currently has one limousine permit and is requesting two additional permits for limousines. City Clerk informed that Mr. Zentgraf's business address is currently 3811 Seymour Highway and he is the only one licensed to operate as a chauffeur under his franchise. His other drivers will have to apply for permits as well prior to operating. Councilor Gonzalez asked where all the limousines are stored. City Clerk informed on the information that is provided by the franchise holders in their application. Mr. Zentgraf informed that his place of business is 3811 Seymour Highway, however, he stores his limousines in a locked warehouse on Avenue K and Kemp. He said he wants to provide attractive vehicles and quality service. 36 1 Item 7a continued Mayor called for additional public comments. There being none, Mayor declared the public hearing closed. Item 7b ORDINANCE NO. 19-2007 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING ORDINANCE NO. 104-2005, TO INCREASE THE NUMBER OF SPECIAL SERVICE VEHICLES PERMITTED TO DAVE ZENTGRAF DBA MOONLIGHT LIMOUSINE SERVICE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW Moved by Councilor Hatcher that Ordinance No. 19-2007 be passed. Motion seconded by Councilor Elmore and carried by the following vote. Ayes: Mayor Lyne, Councilors Ginnings, Ammons, Roberts-Burns, Hatcher, Gonzalez, and Elmore Nays: None Item 8a ORDINANCE NO. 20-2007 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING SECTION 106-128 OF THE CODE OF ORDINANCES REGARDING CREDIT CARD PAYMENTS FOR UTILITY BILLS; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW Moved by Councilor Roberts-Burns that Ordinance No. 20-2007 be passed. Motion seconded by Councilor. Councilor Ammons stepped out of Council Chambers. Motion carried by the following vote. Ayes: Mayor Lyne, Councilors Ginnings, Roberts-Burns, Hatcher, Gonzalez, and Elmore Nays: None Item 9a RESOLUTION NO. 25-2007 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, APPROVING AMENDMENTS TO THE 2006-2007 BUDGET OF THE 4B SALES TAX BOARD FOR DEBT SERVICE AND A GRANT TO THE KEMP CENTER FOR THE ARTS; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW Moved by Councilor Roberts-Burns that Resolution No. 25-2007 be passed. Motion seconded by Councilor Elmore. Councilor Ammons returned to Council Chambers. Motion carried by the following vote. �7 Item 9a continued Ayes: Mayor Lyne, Councilors Ginnings, Ammons, Roberts-Burns, Hatcher, Gonzalez, and Elmore Nays: None Item 9b RESOLUTION NO. 26-2007 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH THE NORTH CENTRAL TEXAS OFFICIALS ASSOCIATION FOR ADULT ATHLETIC LEAGUE OFFICIATING SERVICES; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW Moved by Councilor Elmore that Resolution No. 26-2007 be passed. Motion seconded by Councilor Ammons and carried by the following vote. Ayes: Mayor Lyne, Councilors Ginnings, Ammons, Roberts-Burns, Hatcher, Gonzalez, and Elmore Nays: None Item 9c RESOLUTION NO. 27-2007 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING PARTICIPATION IN THE NORTH TEXAS REGIONAL DRUG ENFORCEMENT TASK FORCE, AUTHORIZING THE EXECUTION OF AN INTERLOCAL AGREEMENT FOR DRUG TASK FORCE SERVICES WITH VARIOUS PARTICIPATING ENTITIES IN A NINE COUNTY REGION IN NORTH TEXAS, TERMINATING EXISTING DRUG TASK FORCE AGREEMENTS, AND MAKING BUDGETARY APPROPRIATIONS FOR THE PROGRAM.; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW Moved by Councilor Elmore that Resolution No. 27-2007 be passed. Motion seconded by Councilor Ammons and carried by the following vote. Item 9d RESOLUTION NO. 28-2007 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, TO APPROVE AN ENGINEERING SERVICES CONTRACT WITH BIGGS & MATHEWS, INC. FOR THE DESIGN OF THE GREGG ROAD/LANGFORD WIDENING PROJECT; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW Moved by Councilor Ammons that Resolution No. 28-2007 be passed. 38 Item 9d continued Motion seconded by Councilor Gonzalez and carried by the following vote. Ayes: Mayor Lyne, Councilors Ammons, Roberts-Burns, Hatcher, Gonzalez, and Elmore Nays: None Item 10a City Manager informed that the Council Strategic Planning Meeting will be held February 27, 2007 at the Wichita Falls County Club. Item 10b Councilor Ammons mentioned the League of Women Voters' pamphlet on recycling and how informative it was. She suggested that the City send this out to our citizens on their water bill or place it on the City's website. Mayor Lyne directed that it be sent out with the next City Newsletter. Councilor Gonzalez informed that the District 4 town hall meeting had been changed from March 15 to March 22 at Kickapoo Airport. He invited everyone to attend and participate. Councilor Hatcher stated that the Taste of the Town was coming up soon. He congratulated Mr. Roby Christi on his award. Mayor Lyne informed that Councilor Ginnings had to leave because he was a little under the weather. Mayor congratulated Mr. Bob Sullivan and the MPEC Staff for the great job they did on two recent events held at MPEC, the Board/Commission Appreciation luncheon and the SAFB Awards banquet.
