ORDINANCE NO. 63-2008
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, ORDINANCE AMENDING ORDINANCE NO. 37-2008
DECLARING CERTAIN STRUCTURES AS DANGEROUS BY
ALLOWING EXTRA TIME TO REHABILITATE 100 CLEVELAND TO
CITY COUNCIL; FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC
AS REQUIRED BY LAW.
WHEREAS, the property at LOT 6& E 40 FT LOT 7 LESS ROW BLK 23
Bateson 2" Addition (aka 100 Cleveland), currently owned by Monte Carlo Downing,
was included in a list of properties that were declared hazardous structures at the City
Council meeting of August 5, 2008; and,
WHEREAS, Mr. Downing has requested time to rehabilitate this structure; and,
WHEREAS, the City Council desires to grant additional time in the form of a
restoration permit for his property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Additional time in the amount of 30 days to end at the end of the
business day is granted to the property owner of 100 Cleveland to obtain a Restoration
Building Permit, substantial progress shall have been accomplished 120 days after
the above date, and complete restoration be accomplished by the end of the business
day 120 days from issuance of the permit. Failure to complete timeframe
requirements will result in the demolition of the structure, without further notification.
Upon rehabilitation of structure, the demolition order shall become void.
SECTION 2 Due to the fact that the subject matter of this ordinance affects the
public health, safety and welfare of the citizens of the City of Wichita Falls, this
ordinance is declared to be an emergency measure, and shall become effective
immediately upon its passage.
SECTION 3. It is hereby officially found and determined that the meeting at which
this ordinance was passed was open to the public as required by law.
