ORDINANCE NO. - �
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, CLOSING, VACATING, AND ABANDONING A 30 FOOT
UTILITY, TROLLEY, AND WALKWAY EASEMENT APPROXIMATELY
6,464.45 SQUARE FEET IN SIZE KNOWN AS LOT 36, BLOCK 1, SIKES
ESTATES UNIT 1, SECTION G; FINDING AND DETERMINING THAT
THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the current owner/developer has requested the closure of a utility,
trolley, and walkway easement totaling 6,464.45 square feet in an effort to development
this area with residential housing; and
WHEREAS, all affected City departments and affected utility companies have
been contacted and have approved this closure; and
WHEREAS, the City Council of the City of Wichita Falls, Texas deems it
advisable and in the best public interest to close, vacate, and abandon the easement
hereinafter described subject to the filing of a final re-plat within six-months of the date
of approval of this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. That the 6,464.45 square foot utility, trolley, and walkway easement
located across Lot 36, Block 1, Sikes Estates, Unit , Section G, Wichita Falls, Wichita
County, Texas, is hereby closed, abandoned and vacated. Said easement is shown as
indicated on the attached plat, incorporated in this ordinance as Exhibit "A" Location
Map.
SECTION 2. That in consideration of the payment of Four Thousand Eight
Hundred Forty-Eight Dollars and No/100 ($4,848.00) for the fair market value of the
property, this ordinance shall authorize the City Manager to execute a quitclaim deed for
the City's interest in the property. The deed shall be executed conditioned upon the
property owners filing an approved re-plat of the property in the records of the Wichita
County Clerk. This filing shall occur within six (6) months of the date of approval of this
ordinance. This ordinance shall be void and have no effect if said re-plat is not
approved and filed within the stipulated time period.
SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
