FALLS, TEXAS, ORDINANCE AMEND
DECLARING CERTAIN STRUCTURIL TATE 100 TO

WHEREAS, the property at LOT 6& E 40 oWned b 7 MonSe Car Downing,
Bateson 2 Addition (aka 100 eS were declared hazardous structures at the City
was mcluded in a list of prope
Council meeting of August 5, 2008; and,
EAS Mr. Downing has requested time to rehabilitate this structure; and,
WHER ,
WHEREAS, the City Council desires to grant additional time in the form of a
restoration permit for his property•
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Additional time in the amo of 100 Cleve and obtain Res o ation

ORDINANCE OF THE CITY OF WICHITA FALLS CLOSING,
ABANDONING, AND VACATING A TEN FOOT UTILITY EASEMENT
CROSSING THE NORTH PORTION OF 3303 MOCKINGBIRD LANE
CONTAINING APPROXIMATELY 2,010 SQUARE FEET AS INDICATED
IN THE ATTACHED EXHIBIT "A"; FINDING AND DETERMINING THAT
THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the property owner of 3303 Mockingbird Lane has requested to
close, abandon, and vacate that portion of a ten-foot utility easement across the north
portion of their property as indicated in Exhibit "A"; and
WHEREAS, all affected utility companies and City departments have reviewed
this request and have recommended approval of this closure; and
WHEREAS, The City Council of Wichita Falls, Texas deems it advisable and in
the best public interest to close, vacate, and abandon that portion of the utility easement
herein indicated in Exhibit "A".
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. That the approximately 2,010 square foot utility easement known as
3303 Mockingbird Lane and dedicated on the plat of Lot 2 Block 42 of the Country Club
Estates an addition to the City of Wichita Falls, is hereby closed, abandoned and
vacated. Said easement is shown as indicated on the attached Exhibit "A" map and
incorporated in this ordinance.
SECTION 2 . That in consideration of the receipt of $4,020.00 for the cost of the
property and $250.00 for the cost of the appraisal, this ordinance shall authorize the
City Manager to execute a quitclaim deed for the City's interest in the property. The
deed shall be executed conditioned upon the property owner filing an approved re-plat
of the property in the records of the Wichita County Clerk. This filing shall occur within
ninety days of the date of approval of this ordinance. This ordinance shall be void and
have no effect if said re-plat is not approved and filed within the stipulated time period.
SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
