Ord 69-2008 10/21/2008 . �� � ORDINANCE NO. -��� ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING THE CODE OF ORDINANCES, ARTICLE III, DIVISION 2, SEC. 2-126 - SEC. 2-131 THAT ESTABLISHES, DEFINES MEMBERSHIP, AND SETS DUTIES OF THE ARTS COMMISSION; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, it is desirable to review City boards and commissions periodically in order to make changes that ensure they are relevant to the accepted goals; and WHEREAS, the Arts Commission has reviewed Code of Ordinances Article III, Division 2, Sec. 2— 126 — Sec. 2— 131 that establishes, defines membership, and sets duties of the Arts Commission; and WHEREAS, the attached changes are desirable to keep the Arts Commission relevant and to function better. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1 . The attached amendments to the Code of Ordinances Article III, Division 2, Sec. 2-126 - Sec. 2-131 that establishes, defines membership, and sets duties of the Arts Commission are hereby adopted. SECTION 2.. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law. Created; appointment; terms; compensation; vacancies. (a) There is created an arts commission which shall be comprised of 9 city citizens. (b) All members shall be appointed by the city council. Such members shall be appointed for a term of two years expiring Juty 31 or until a successor is appointed. Terms shall be so staggered that approximately one-half of the commission shall be appointed each year, split proportionately between the agency members and the community members. (c) Members shall serve without pay. (d) All vacancies shall be filled for the unexpired terms by the city council. (Code 1966, § 2-160.19) Sec. 2-127. Agency members. (a) Five members of the arts commission shall be chosen from those agencies that have a primary concern for promoting, teaching and sponsoring arts or cultural activities and that are nonprofit with a tax exempt status. The following agencies meet these requirements: (1) Wichita Falls Art Association. (2) Wichita Falls Symphony Orchestra (3) Wichita Falls Ballet Association. (4) Museum of North Texas History. (5) Wichita County Heritage Society. (6) Backdoor Theatre. (7) Kemp Center for the Arts. (8) Midwestern State University. (b) Nominees may be submitted by each agency to the city council when a vacancy occurs. (Code 1966, § 2-160.20; Ord. No. 50-2004, §§ 1, 2, 7-6-2004; Ord. No. 62-2005, §§ 1, 2, 8-16-2005) Sec. 2-128. Community members. Four of the members of the arts commission shall be appointed to represent the business community, foundations, professional groups, and the public at large. These community members shall be appointed by the city council. If additional agency members are added in the future, one additional community member shall be added for each agency member. (Code 1966, § 2-160.21) Sec. 2-129. Ex officio member. Staff persons of the agencies represented on the arts commission may serve as ex officio members of the commission. The Public Information Coordinator shall also serve as an ex officio member. These members shall have no vote in the deliberations of the commission. > � � t (Code 1966, § 2-160.22) Sec. 2-130. Officers; meetings; quorum. (a) From among its members, the arts commission shall select a chairperson, vice- chairperson and secretary. (b) Meetings will be held as determined necessary by the commission members. (c) Five members shall constitute a quorum. Favorable action shall require a vote of a majority of the quorum present. (Code 1966, § 2-160.23) Sec. 2-131. Purpose; funding. (a) The purpose of the arts commission is to promote artistic and cultural activities in the city. The commission is designed to facilitate communication between organizations fostering the arts and cultural activities. The commission shall also serve as an advisory body to the city council for the annual allocation of city funds made available to support and promote the artistic and cultural resources of the city. (b) The city council shall establish annually the amount of funds which shall be available for the support and promotion of artistic and cultural resources in the city. All approved activities should be designed to increase tourism, promote the city's economic base, and enlarge the cultural opportunities for area residents. Recommendations for funding should be so developed as to take full advantage of matching funds made available through such programs as the National Endowment of the Arts, the state commission on arts and humanities, the national trust for historical preservation, the state department of transportation, the state bureau of outdoor recreation, the national park service, foundations, and other public or private resources. (c) Prior to June 1 of each year, the commission shall forward to the city council a list of priorities for programs or project funding for the next fiscal year, along with full descriptions of such. Upon approval by the city council of projects or programs to be funded, expenditures will be authorized upon proper invoice. (Code 1966, § 2-160.24) Secs.2-132--2-160.
