ORDINANCE NO. 74-2008
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AMENDING ORDINANCE NO. 37-2008 TO GRANT
ADDITIONAL TIME FOR THE OWNER OF THE PROPERTY AT 1004
WOODS STREET TO REHABILITATE THE STRUCTURE; DECLARING
AN EMERGENCY; FINDING AND DETERMINING THAT THE MEETING
AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, the property at 1004 Woods Street was included in a list of
properties for consideration as hazardous structures by the City Council at their meeting
on August 5, 2008; and,
WHEREAS, Ms. Stephen appeared at the meeting and requested time to
rehabilitate the structure; and,
WHEREAS, the City Council granted Ms. Stephen thirty (30) days to obtain a
restoration permit, and an additional one hundred twenty (120) days show substantial
progress, clean up and secure the property; and,
WHEREAS, failure to meet the 30-day requirement for obtaining a restoration
permit resulted in award of bid and contract for demolition of the property; and,
WHEREAS, it is the desire of the City Council to grant the property owner
additional time to rehabilitate the structure.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . Additional time in the amount of 150 days to end at the end
of the business day on _April 17, 2009 is granted to the property owner of 1004 Woods
Street to have accomplished substantial progress on the rehabilitation of this structure;
and a Certificate of Occupancy shall be obtained by the end of the business day on
April 17, 2009. Failure to complete these timeframe requirements will result in the
demolition of the structure, without further notification. Upon issuance of a Certificate of
Occupancy, the demolition order shall become void.
SECTION 2. Due to the fact that the subject matter of this ordinance affects the
public health, safety and welfare of the citizens of the City of Wichita Falls, this
ordinance is declared to be an emergency measure and shall become effective
immediately upon its passage.
SECTION 3. It is hereby officially found and determined that the meeting at
