RESOLUTION NO. �E�aOOS
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, TO ACCEPT CHANGE ORDER NO. 2 FOR THE
CYPRESS WATER TREATMENT YARD PIPING PHASE 1 PROJECT
(CWF03-544-23) AND ACCEPT THE CYPRESS WATER TREATMENT
PLANT YARD PIPING PHASE 1 PROJECT (CWF03-544-23) AND
AUTHORIZE FINAL PAYMENT TO MW BUILDERS OF TEXAS; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered into a lump price contract with MW
Builders of Texas with the estimated total cost of $1,757,000.00; and
WHEREAS, Change Order No. 2 will add $36,178.00 to the contract for a revised
cost of $1, 814,182.00; and
WHEREAS, the City staff has reviewed all aspects of this change order and feels
it is in the City's best interest to approve, and
WHEREAS, the actual work was completed at a total cost of $1,814,182.00,
including Change Order No. 2 of which $1,518,135.00 has been paid to the Contractor,
with $175,500.00 (351 Days @$500.00) of Liquidated Damages being charged to the
Contractor due to project completion delays, leaving a balance due of $120,547.00;
and
WHEREAS, the City has inspected the work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Change Order No. 2 for the Cypress Water Treatment Yard Piping
Phase 1 Project (CWF03-544-23) is hereby approved and the Cypress Water Treatment
Plant Yard Piping Phase 1 Project (CWF03-544-23) is hereby accepted and the City
Manager is authorized to execute final payment to MW Builders of Texas.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
